Home My WebLink AboutOrdinance - 9484-1991 - Closing A Portion Of An Electrical Line Easement - 10/10/1991• !j ... • JWF:js ... 29400 File And Return To Ed Bucy R·O-W First Reading October 10, 1991 Item #17 Second Reading October 22, 1991 Item fl5 ORDINANCE NO. 9484 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF AN ELECTRICAL LINE EASEMENT LOCATED IN SECTION 15, BLOCK A, LUBBOCK, LUBBOCK COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED HEREINAFTER IN THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL HAPS OF THE CITY TO REFLECT SAID ABANDON- MENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that a portion of the electrical line easement as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the a portion of the electrical line easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use and being more particu- larly described as follows: BEGINNING at the Southeast corner of Block 1, Western Ways Addition to the City of Lubbock, lubbock County, Texas; THENCE West along the North property line of the larry Adams tract, a distance of 833.82 feet to a point; THENCE S. 21°09' West a distance of 16.00 feet to a point; THENCE East a distance of 58.00 feet to a point, point being the Northwest and beginning corner of this electrical line easement to be abandoned and closed; THENCE S. 21°09' West a distance of 40.00 feet to a point; THENCE East a distance of 2.00 feet to a point; THENCE N. 21°09' East a distance of 40.00 feet to a point; THENCE West a distance of 2.00 feet to the POINT OF BEGINNING. The remainder of the said Electrical line Easement (which is recorded at Volume 824, Page 273 of the Deed Records of lubbock County, Texas) which is not hereby abandoned, vacated and closed is hereby retained by the City of Lubbock. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
