ORDINANCE NO. 9478
AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON JANUARY 18,
1992, FOR THE PURPOSE OF VOTING FOR OR AGAINST THE ADOPTION OF AN ADDITIONAL
ONE-HALF OF ONE PERCENT SALES AND USE TAX WITHIN THE CITY TO BE USED FOR
REDUCTION OF THE CITY PROPERTY TAX RATE (1/8 CENT) AND FOR THE BENEFIT OF AN
ECONOMIC DEVELOPMENT CORPORATION (3/8 CENT); MAKING PROVISION FOR THE CONDUCT OF SUCH ELECTION ACCORDING TO APPLICABLE PROVISIONS OF LAW;
PROVIDING FOR NOTICE OF THIS ELECTION BY PUBLICATION OF THIS ORDINANCE;
PROVIDING FOR EXECUTION OF AN APPROPRIATE ELECTION ORDER HEREAFTER; AND
OTHER PROVISIONS INCIDENT TO AND RELATED TO THE PURPOSE HEREOF; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT a special election be held on the 18th day of
January, 1992, which date is the first authorized uniform election date that is the first succeeding uniform election date after passage of this
Ordinance for which sufficient time elapses for the holding of an election.
Said election shall be held to determine whether an additional one-half of
one percent sales and use tax should be imposed within the City of Lubbock
for reduction of the City property tax rate (1/8 cent) and for the benefit
of an economic development corporation (3/8 cent) pursuant to Section 4A of
Article 5190.6, V.A.C.S.
SECTION 2. THAT electronic voting machines shall be used in this
election and for absentee voting by personal appearance and by mail and each
voter shall record his vote by punching a hole in a ballot which is to be
counted by data processing machines. Punch-card ballots and punch-card
ballot labels shall be prepared in accordance with the applicable provisions
of the Election Code so that voters may cast their ballots either "FOR" or
"AGAINST" the measure which shall appear on the ballot substantially as
follows:
PROPOSITION NO. 1
"THE ADOPTION OF A SALES AND USE TAX WITHIN THE CITY FOR THE
PROMOTION AND DEVELOPMENT OF NEW AND EXPANDED BUSINESS
ENTERPRISES AT THE RATE OF THREE-EIGHTHS OF ONE PERCENT AND THE
ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT
THE RATE OF ONE-EIGHTH OF ONE PERCENT TO BE USED TO REDUCE THE PROPERTY TAX RATE 0 •
SECTION 3. THAT the election shall be held at the polling places set
forth in an appropriate election order issued by the Mayor hereafter and all
persons qualified to vote in said City under the election laws of the State
of Texas shall be allowed to vote therein. Said special election shall be
held and the polls shall be open from 7:00A.M. to 7:00 P.M. and all
electors shall vote in the precinct of their residence unless otherwise
provided for in the election order.
SECTION 4. THAT notice of this election shall be published in a
newspaper of general circulation published in the community by publication
of this Ordinance in its entirety upon the same day in each of two
successive weeks, with the first publication occurring before the 14th day
before the date of the election.
SECTION 5. THAT absentee voting shall be conducted at the City
Secretary's office during normal working hours and from 8:00 A.M. to
5:00 P.M. on the last Saturday of the absentee voting period at the Lubbock
Municipal Building, 1625 13th Street, lubbock, Texas.
SECTION 6. THAT this election shall be held concurrently with a
Charter Amendment Election presenting the issue of whether Chapter 3 of the
City Charter pertaining to the Board of City Development should be repealed.
AND IT IS SO ORDERED.

ELECTION ORDER
I, B. c. McMinn, Mayor of the City of Lubbock, Texas, by
virtue of the authority vested in me by law, and according to the
Charter of the city of Lubbock, the Texas Election Code, the
Texas Tax Code, the Texas Local Government Code, Article 5190.6
of Vernon's Annotated Texas Civil Statutes, the Lubbock City
Charter and the City Ordinances entitled Ordinance No. 9478 and
Ordinance No. 9479 enacted on October 10, 1991, hereby order a
Special City Election to determine whether an additional one-half
of one percent sales and use tax {at the rate of three-eighths of
one percent for the promotion and development of new and expanded
business enterprises and at the rate of one-eighth of one percent
to be used to reduce the property tax rate) and a City Charter
Amendment Election {to consider repealing and thus deleting from
the City Charter Chapter 3 pertaining to the Board of City
Development) to be held concurrently in the City of Lubbock,
Texas, on the 18th day of January, 1992, such day being the first
succeeding uniform election date more than thirty {30) days after
passage of the ordinances calling for such elections providing
sufficient time to comply with all applicable laws pertaining to
such elections.
Electronic voting machines and a joint ballot shall be used
in such elections and for absentee voting by personal appearance

PROPOSITION NO. 2
11 SHALL THE CHARTER OF THE CITY OF LUBBOCK BE AMENDED BY
REPEALING AND THEREBY DELETING THEREFROM CHAPTER 3
PERTAINING TO THE BOARD OF CITY DEVELOPMENT; INCLUDING
PROVISIONS FOR ESTABLISHING MEMBERSHIP, TERMS OF
OFFICE, VACANCIES AND APPOINTMENTS, AND APPROPRIATIONS
FOR SUCH BOARD.11
Said elections shall be held at the places in the City of
Lubbock hereinafter designated as voting precincts and voting
places on Exhibit A hereto, which Exhibit A shall be made a part
hereof for all intents and purposes. Polling places shall be
open from 7:00 A.M. to 7:00 P.M. and all electors shall vote in
the precinct of their residence unless such precinct shall be
consolidated with another precinct as provided herein in Exhibit
A.
The persons set forth in Exhibit B, which is attached hereto
and made a part hereof for all intents and purposes, are hereby
appointed Judges and Alternate Judges to hold said City elections
on January 18, 1992. Each Presiding Judge so named is authorized
to appoint the number of clerks authorized by the Election
Administrator, which number shall not be less than two clerks nor
more than six clerks. The Alternate Judges shall serve as
Presiding Judges in the event that the regularly appointed
Presiding Judge is unable to serve. The Alternate Judge shall be
appointed by the Presiding Judge to serve as one of the clerks in
the event that the election is conducted by the regularly
appointed Presiding Judge.
Early balloting shall be conducted at the office of the city
secretary during normal working hours of that office and from
8:00 A.M. to 5:00 P.M. on the last Saturday of the early voting
period at the Lubbock Municipal Building, 1625 13th Street,
Lubbock, Texas.
ELECTION NOTICE
The City Secretary of the City of Lubbock is hereby ordered
to cause publication of these elections by publication of this
Order and Notice of Special City Election and Charter Amendment
Election in a newspaper of general circulation published in the
City of Lubbock upon the same day in each of two successive
weeks, with the first publication occurring before the 14th day
before the date of the election and the second publication
occurring not less than the lOth day before election day. The
City Secretary shall serve a duly certified copy of this Election
Order and Notice upon each of the Presiding Judges named in
Exhibit B hereto not later than the seventh day after the signing

of this Election Order and Notice or the 15th day before the
elections, whichever is later.
