Amending Section 28-86 - 08/08/1991II j I DGV:dw Firs·t: Reading August 8, 1991 Item #17 Second Reading August 22, 1991 Item 1110 ORDINANCE NO. 9473 AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING SECTION 28-86 WITH REGARD TO RATES CHARGED FOR SEWER SERVICE WITHIN THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to adjust sewer charges within the City of Lubbock to reflect the cost of service; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-86 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Sec. 28-86. Rates charged for sewer service. {a) Sewer service charges presently in effect under this section shall remain effective for all billings scheduled to be rendered until October 1, 1991, and thereafter there shall be charged for sewer service to all residences. places of business, private and public buildings, churches, schools, institutions, and all other sewer services customers the following service charges: Residential: Individually metered residential six dollars and ten cents {$6.10} per month minimum including three thousand (3,000} gallons; seventy-five cents ($0.75) per thousand gallons per month thereafter maximum charge eleven dollars and thirty-five cents ($11.35) (10,000 gallons per month) for each non-sprinkler meter. Individually metered residential units shall pay the above service charge based on a calculated estimate of sewer flow determined from water consumption records for individual customers. Water consumption information for months of typically low irrigation usage will be examined to establish a "basis" for sewer service charges. Sewer charges will be levied based on water consumption up to the maximum determined by the 11 basis." The basis for new customers shall be six thousand (6,000) gallons until adequate historical information is available. Commercial: 5/8 inch or 3/4 inch meter 1 and 1 1/4 inch meter 1 1/2 inch meter 2 inch meter 3 inch meter 4 inch meter 6 inch meter 8 inch meter 10 inch meter Universities, schools, geriatric institutions, orphan homes, public or private institutions, public schools, churches, multi- family residential and all other sewer service customers - 2 - $6.10 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $14.74 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $26.26 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $37.78 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $101.12 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $175.98 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $382.05 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $518.61 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. $835.32 per month minimum including 3,000 gallons; $0.75 per thousand gallons per months thereafter. The charge for these users shall be the same as the commercial rate. ~ II I I I except individually metered residents and industrial customers. Industrial: The charge for industrial users shall be the same as the commercial rate. (b) Surcharge: Sewer customers or others discharging wastes to the sanitary sewer system which do not exceed the limits established in Section 28-99 of this Ordinance and which do not exhibit any of the characteristics of wastes prohibited by Sections 28-98 and 28-100 but have concentration(s) in excess of "normal domestic sewage•, shall pretreat the wastes to meet the concentrations of •normal domestic sewage"; however, such excessive BOD and TSS wastes may be accepted for treatment if all the following requirements are met: (1) (2) (3) (4) The wastes will not cause damage to the wastewater collection system; The wastes will not impair the City's treatment process; The wastes will not cause contamination of POTW sludges thus limiting sludge disposal options or practices; The person(s) or owners responsible for the wastes pays a Surcharge, in addition to the regular water and sewer rates, in accordance with the following cost factors and formula: V • Volume reported in millions of gallons (MG) I BOD = Biochemical Oxygen Demand analyzed in accordance ! with the latest edition of "Standard Methods for the [ Examination of Water and Wastewater", or the latest , TSS EPA approved method, and reported in units of ! milligrams per liter (mg/1), j • Total Suspended Solids analyzed in accordance with 1 the latest edition of "Standard Methods for the Examination of Water and Wastewater•, or the latest EPA approved method, and reported in units of milligrams per liter (mg/1), Cost Factor BOD_• 30%.of the total budgeted costs for operating and maintaining the wastewater treatment facilities divided by total pounds BOD treated · Cost Factor TSS • 27.5% of the total budgeted costs for operating and maintaining the wastewater treatment facilities divided by total pounds TSS treated - 3 - Surcharge • Surcharge computed in dollars as follows: BOD Surcharge • V x (B -C) x 8.34 x Cost Factor BOD TSS Surcharge • V x (B -C) x 8.34 x Cost Factor TSS where: B z Total contribution from user (mg/1) C • Normal domestic sewage strength (mg/1) 8.34 • pounds per gallon of water (conversion) (c) The rates for sewer service as shown in paragraph (a), shall be adjusted to produce nine percent (9%) more revenue, not including growth factors, than the previous year as of October 1, 1992 and ten percent (10%) more revenue, not including growth factors, than the previous year as of October 1, 1993, and, in addition, such rates shall be reviewed annually thereafter to ensure the adequacy of the rates to cover the total cost of operation, maintenance, and capital costs of the sanitary sewer utility. These rates shall be examined by the assistant city manager for financial services and the assistant city manager for financial services shall make such recommendations for adjustments and changes in such rates to the City Council as deemed necessary after each annual review for consideration by the City Council. The surcharge rate for sewer service as shown in paragraph (b), shall be determined each year following City Council approval of the annual operations budget. The surcharge rate shall be examined by the assistant city manager for financial services and such adjustments shall be made to the sewer surcharge rate on October 1 of each year. (Ord. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or void for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3.
