This Ordinance abandons and closes a dedicated 20' by
240' north-south alley located north of 23rd Street
and just east of Albany Avenue, and the closure is for
replatting and building expansion. The proponent of
this closure is Richard Webb, builder. The area being
closed is 4,800 square feet and it will remain a
Utility Easement. The property owner is dedicating
900 square feet of street right-of-way for 23rd Street
and a 25' by 450' Utility Easement across the northern
portion of his property which more than offsets the
area being closed. Staff recommended approval.
Motion was made by Councilwoman Baker, seconded by
Mayor Pro Tern Patterson to pass on first reading
Ordinance #9416 as recommended by Staff. Motion
carried: 7 Yeas; 0 Nays.

AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF AN ALLEY LOCATED
ADJACENT TO LOTS 1 THROUGH 8, BLOCK 3, SUNSHINE ADDITION TO THE CITY OF
LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED
HEREINAFTER IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO
MAKE THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMNET AND
CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.

This Ordinance closes a 15' wide by 225' long north-
south alley located just east of Avenue H {1-27~
between 30th and 31st Streets. Proponent of th1s
closure is Clear-Vu Autos, and the reason for closure
is for replatting purpos.es. Total area being closed
is 3,375 square feet. The property is valued by the
Appraisal District .at $1.25 per sq~are foot •. !he
alley area being closed is to rema1n as a Ut1l1ty
Easement and since the area can only be used for
parking ~r landscaping and cannot be built on, the
Right-Of-Way Department appraised this area being
closed at SOt per square foot, or $1,687.50 payment to
the City. All utilities are in agreement, si~ce it
will remain as an Easement, and the $150 appl1cation
fee has been paid. Staff recommended approval.

Mayor Pro Tern Patterson to pass on first reading
Ordinance #9417 as recommended by Staff. Motion
