ORDINANCE NO. 9411
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK,
TEXAS, WITH REGARD TO ENGINEERING FOR PAVING IMPROVEMENTS, SUBDIVISIONS AND WATER AND SEWER INSTALLATION; UNIT PRICES FOR WATER AND SEWER EXTENSIONS;
PROVIDING FOR CORRECTION OF TYPOGRAPHICAL AND OTHER ERRORS; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock, Texas, deems it to
be in the best interest of the health, safety and welfare of the citizens
of the City of Lubbock to amend the Code of Ordinances of the City of
Lubbock with regard to engineering for paving improvements, subdivisions
and water and sewer pro rata and unit prices for water and sewer exten-
sions; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 24-158 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows:
Sec. 24-158. Engineering for paving improvements.
The performance of engineering services for paving and drainage improvements shall conform to the following:
{a) The City engineering staff will perform or provide for engi-
neering services on City Council authorized street paving,
alley paving or drainage projects.
{b) The proponent may utilize engineering services performed by
either the city engineering staff or an engineering consultant
for improvements constructed by a Street Use Permit {Section
24-151) or Alley Use Permit {Section 24-167). If an engineer-
ing consultant is utilized, the requirements of paragraph {c)
following will apply.
(c) Paving and drainage improvements required by Chapter 25
(Subdivision Regulations) of this Code shall conform to the
following:
(I) The engineering plans, specificatipns, estimates and
staking shall be done by the property developer's engi-neering consultant.
(2) The property developer's engineering consultant shall
prepare plans for review and approval by the city engi-
neer prior to actual start of construction. The consul-
tant shall obtain from the city engineer the most current

City Council approved specifications for paving and
drainage improvements for use on the project. The devel-
oper's engineering consultant shall be a professional
engineer registered in the State of Texas whose specialty
is civil engineering.
The city engineer shall express written approval or
disapproval of such plans and shall state the conditions,
if any. of such approval or disapproval. No construction
shall start prior to written approval by the city engi-
neer.
Testing and inspection of the paving or drainage improve-
ment project shall be performed by the city engineering
staff under the supervision of the city engineer. The
city engineer may require certain tests of materials be
performed by private testing laboratories.
The developer's engineering consultant shall provide
construction staking and grade elevations for the paving
contractor as established by the plans approved by the
city engineer. The city engineer shall receive cut and
fill sheets and verification of stake alignment prior to
actual construction.
Upon completion of construction, the developer (in coop-
eration with the developer's engineering consultant) shall furnish to the city engineer:
a. Complete and accurate reproducible drawings
reflecting actual "as-built" construction signed
and affixed with the seal of the developer's engi-
neering consultant. The plan view shall be on a
one (1) inch equals fifty (50) feet scale with the
profile on a one (1) inch equals one (1) foot or
one (1) inch equals two (2) feet vertical scale.
The profile shall show the ground elevations prior
to construction and the final gutter or flow line
elevations as constructed.
b. A breakdown of actual quantities constructed and
final costs for the work done on a form approved by
the city engineer, signed and affixed with the seal
of the developer's engineering consultant.
(7) After final inspection and approval of the paving
improvements required by Chapter 25 of this Code by the
city engineer, the city engineer shall submit said
improvements to the City Council for their consideration
for approval and acceptance. (Ord. No. 8568. 47, 3-8-84}

(d) The city engineer may allow city staff to perform engineering
services on paving or drainage improvements required by Chapter
25 (Subdivision Regulations) of this Code. This alternative,
if requested by the developer, would only be considered on
small developments (less than $10,000 construction cost as
estimated by the City engineering staff using current City bid
prices).
SECTION 2. THAT Section 24-159 of the Code of Ordinances of the City
of lubbockt Texas, is hereby amended to read as follows:
Sec. 24-159. Fees for paving improvements.
(a) The fees for engineering services, if any, on City Council
authorized paving and drainage projects shall be set by the
City Council.
(b) The fee to the proponent for all engineering services including
staking, testing, and inspection by the City staff for street
or alley use permit paving shall be six (6) percent of the
total estimated cost of construction.
Should the proponent choose to use an engineering consultant to
perform allowed engineering services for street or alley use
permit paving, the provisions of paragraph (c) following will apply.
(c) The fee for engineering services on paving or drainage improve-
ments required by Chapter 25 (Subdivision Regulations) of this
Code shall conform to the following:
(1) The fee to be charged by the City for review of plans,
specifications and estimates prepared by the developer's
engineering consultant shall be fifty dollars ($50.00) or
five tenths of one percent (0.5%) of the estimated cost
of construction, whichever is greater.
(2) The fee to be charged by the City for testing and inspec-
tion services of the improvements shall conform to the
following table:

(d) The fee to be charged for engineering services described in
Sec. 24-158 (d) of this Code shall be six (6) percent of the
estimated construction cost.
(e) Additional fees may be required by the city engineer on a cost
basis for:

Additional charges for testing, inspection and staking in
accordance with current city policies for work requested
by the developer, including but not limited to, increased
costs for city personnel working weekends and/or holi-
days.
Those instances when additional inspection and testing
occur due to deficiencies in construction materials or
workmanship. (Ord. No. 8568, 48, 3-8-84)
SECTION 3. THAT Subsection 25-3(e) of the Code of Ordinances of the
City of Lubbock, Texas, is hereby amended by amending paragraphs (4) and
(5) to read as follows:

The proponent of a final plat shall secure the services of a
Texas registered professional engineer (with a specialty as a
civil engineer or sanitary engineer) for engineering work
necessary for public facilities. The engineer shall prepare
plans, specifications and estimates for water, sewer, street
and drainage improvements. The City will perform testing and
inspection of the improvements during construction.
Engineering shall be in accordance with the provisions of this
Code. Upon payment of review fees established by Chapters 24
and 28 (as amended) of this Code, the Water Utilities Engineer
and the City Engineer shall review plans, specifications and
estimates prepared by the proponent's engineer in a timely
manner.
The Water Utilities Engineer and the City Engineer shall
express written approval or disapproval of such plans, specifi-
cations or estimates and shall state the conditions, if any, of
such approval or disapproval.
Fees for testing and inspection of required improvements, as
established by Chapters 24 and 28 (as amended) of this Code,
shall be paid prior to installation of these public facilities.
SECTION 4. THAT Subsection 25-6(a) of the Code of Ordinances of the
City of Lubbock, Texas, is hereby amended by amending paragraph (5) to read
as follows:

(5} The final plat shall be accompanied by documents bearing the
seal of a Texas registered professional engineer with special-
ties in civil engineering or sanitary engineering. Such docu-
ments must have written approval by the city engineer or water
utilities engineer prior to any construction. Such documents
shall include:
(a} Sewer -Detailed engineering documents as required at
Chapter 28 of this Code.
(b) Water -Detailed engineering documents as required at
Chapter 28 of this Code.
(c) Streets, alleys, curbs and gutters -Detailed engineering
documents as required at Chapter 24 of this Code.
(d) Storm drainage -Detailed engineering documents for
drainage as discussed at Chapters 21 and 25 of this Code.
SECTION 5. THAT Chapter 28 of the Code of Ordinances of the City of
Lubbock, Texas, be amended by deleting all references to "water
superintendent" and substituting therefor the title "Director of Water
Ut il it i es. "
SECTION 6. THAT Section 28-33 of the Code of Ordinances of the City
of Lubbock, Texas, be amended by deleting the word "value" and substituting therefor the word "valve ...
SECTION 7. THAT paragraph (a} of Section 28-43 of the Code of
Ordinances of the City of lubbock, Texas, be amended to read as follows:
Sec. 28-43. Diversion of water.
(a} Any person who intentionally, by any means or device,
prevents water passing through any meter belonging to the water
department or used in connection with the supply of water to any
consumer by the water department to register the amount of department
water passing through meters, or intentionally prevents a meter from
duly registering the quantity of water supplied, or in any way it
interferes with its proper action or just registration or without the
consent in writing of the Director of Water Utilities intentionally
diverts any water from any pipe of the city waterworks, or otherwise
intentionally uses, or causes to be used, without the consent in
writing of the Director of Water Utilities, any water produced or
distributed by the water department with intent to defraud the city
water system, shall be guilty of a misdemeanor.
SECTION 8. THAT Section 28-58 of the Code of Ordinances of the City
of Lubbock, Texas, is hereby amended to read as follows:

Sec. 28-58. Water Service Connections.
The following fees shall be charged on all water installations
requiring the following sizes of service connections:
For service connections of less than one inch ••••.•..••• $120.00
For service connections of one inch ••••••••••..••.•••..• $135.00
For service connections exceeding one inch •..••.•••..••. Cost as
determined by City Water Engineer.
SECTION 9. THAT the Code of Ordinances, City of Lubbock, Texas, is
hereby amended by adding a section, to be numbered 28-90, which said
section shall read as follows:
Sec. 28-90. Sewer Service Connections.
The following fees shall be charged on all sewer installations (other
than new construction) requiring service connections:
For service connections O' to 5' deep •••••••••••.••.••• $220.00
For 5' to 8' deep ..•••.••••••.••.•••••.•••.••..••..••..• $20.00
for each additional foot.
For 8' and deeper .••••.••••.•.•••••••••.••••.•.••.•.•.•• $30.00

SECTION 10. THAT a new Section 28-91 be added to the Code of Ordi-
nances of the City of Lubbock, Texas, which shall read as follows:
Sec. 28-91. Payment for sanitary sewer line blockages.
In the event any person, firm or institution connected to the City of
lubbock sanitary sewer system is determined to be the cause of
obstruction of the City of Lubbock's sanitary sewer line, the person,
firm or institution responsible shall be assessed a charge no less
than the cost of the personnel and equipment used to unblock the
sewer line and the cost of the personnel and equipment necessary to
clean the sanitary sewer line.
SECTION 11. THAT a new Section 28-92 be added to the Code of Ordi-
nances of the City of Lubbock, Texas, which shall read as follows:
Sec. 28-92. Payment for treatment of wastewater spillage.
In the event any person, firm or institution causes wastewater to be
spilled into any storm sewer or natural water outlet, the person,
firm or institution responsible shall be assessed a charge no less

than the cost of the equipment, personnel and chemicals used to clean
the wastewater spillage.
SECTION 12. THAT subparagraph (4) of Section 28-98 of the Code of
Ordinances of the City of Lubbock, Texas, be amended to read as follows:
(4) Any garbage that has not been ground or shredded to such a
degree that all particles will be carried freely in suspension under
flow conditions normally prevailing in the public sanitary sewers,
with no particles greater than one-fourth inch in any dimension.
SECTION 13. THAT Section 28-102 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows:
Sec. 28-102. Determination of measurement, test, and analysis of
characteristics of water and wastes.
All measurements, tests and analysis of the characteristics of water
and wastes to which reference is made in Sections 28-98 and 28-99 of
this Code shall be determined in accordance with "Standard Methods
for the Examination of Water and Wastewater,'' or EPA approved meth-
ods, and shall be determined at the control manhole provided for in
Section 28-131 of this Code, or upon suitable samples taken at such
control manhole. In the event that no special manhole has been
required, the control manhole shall be considered to be the nearest
downstream manhole in the sanitary sewer to the point at which the
building sewer is connected. In the event the nearest downstream
manhole is unsuitable for collection of a representative sample, the
building's sewer cleanout shall be used for sample collection.
SECTION 14. THAT Section 28-108 of the Code of Ordinances of the City of lubbock, Texas, be amended to read as follows:
Sec. 28-108. Accidental discharge.
Each user shall provide protection from accidental discharge of
prohibited materials or other substances regulated by this Ordinance
within 90 days from the effective date of this Ordinance. Facilities
to prevent accidental discharge of prohibited materials shall be
provided and maintained at the Owner or User's own cost and expense.
In the case of an accidental discharge, it is the responsibility of
the User to immediately notify the City of Lubbock Water Treatment
Control Room at 767-2587, 24 hours a day, 7 days a week, of the
incident. The notification shall include date, time and location of
discharge, type of waste, concentration and volume, and corrective actions.
SECTION 15. THAT Regulation 9 of Section 28-128 of the Code of Ordi-
nances of the City of Lubbock, Texas, be amended to read as follows:

Regulation 9. Disposal Permit Fees.
Annual disposal permits are obtainable from the Pro Rata Clerk at
1625 13th, Room 107, 767-2333, at a cost of $50.00 per vehicle.
SECTION 16. THAT Regulation 10 of Section 28-128 of the Code of Ordi-
nances of the City of Lubbock, Texas, be amended to read as follows:
Regulation 10. Disposal Permit Renewal.
Existing permits shall be renewed October 1 of each year beginning
October 1, 1991. In the event a septic waste transporter applies for
a new permit or an additional permit after October 1, the permit fee
of $50.00 will be pro-rated in order to include only the months of
waste disposal. The permittee shall renew all permits on October 1
of each year thereafter.
SECTION 17. THAT a new Regulation 11 be added to Section 28-128 of
the Code of Ordinances of the City of Lubbock, Texas, which shall read as
follows:
Regulation 11. Transport Permit Fees.
The following transport fees are obtainable from the City Health
Department, 1902 Texas Avenue, 767-2951 at a cost of:
On-site sewage disposal system •.••• $61.00
Commercial septic tank emptying •••. $61.00
Veterans adm. loan inspection •..••• $21.00
SECTION 18. THAT Section 28-155 of the Code of Ordinances of the
City of Lubbock, Texas, is hereby amended to read as follows:
Sec. 28-155. Developer Installation.
(a) Installation by Developers by Private Contract.
(1) A developer shall contract with a private engineering
firm for the design and preparation of construction plans
for water and sanitary sewer facilities to serve any new
subdivision within the City of Lubbock and including any
access or off-site facilities that may be required.
These plans shall conform in all details to the City's
standard as to design, grade, location, size, and quality of materials and construction.
(2) Plans and profiles submitted by the developer's engineer
shall be inked on standard sheets of tracing mylar.
Plans and profile shall be shown scaled as per City stan-
dard. All known existing or subsurface utility lines and
obstructions shall be shown. Upon, and along with,

submission of preliminary plans for engineering review by
the City, the developer will submit an engineering esti-
mate to cover the costs of water and/or sewer line
construction and then deposit with the Water Utilities
Department a minimum of fifty dollars ($50.00) or five
tenths of one percent (.5%), whichever is greater, for
water line construction, and minimum of fifty dollars
($50.00) or five tenths of one percent (.5%), whichever
is greater, for sewer line construction to cover the cost
of plan review by the City personnel. The engineer
preparing the plans and profiles must be a registered
Professional Engineer in the State of Texas, and he must
affix his seal and signature to all plans and profiles.
In the instance that plans are submitted for re-review
containing substantial changes and/or alterations, an
additional review fee of fifty dollars ($50.00) or five
tenths of one percent (.5%), whichever is greater, for
water line and sewer line construction will be assessed.
(3) INSPECTION FEES.
a. Water Line Construction
Upon preliminary approval and before any construction can
begin on a water line, a fee of one hundred twenty-five
($125.00) or one and five tenths percent (1.5%) of the
estimated cost of construction, whichever is greater,
will be deposited with the Water Utilities Division, and
placed in the Water Pro Rata Fund, to cover the cost of
water line inspection by City personnel. The cost of any
construction required to be accomplished by City crews
will be in addition to the above fees (see Sec. 28-155 at
paragraph 8).
b. Sewer Line Construction
Upon preliminary approval and before any construction can
begin on a sewer line a fee of one hundred twenty-five
($125.00) or one and five tenths percent (1.5%) of the
estimated cost of construction, whichever is greater,
will be deposited with the Water Utilities Division, and
placed in the Sewer Pro Rata Fund, to cover the cost of
sewer line inspection by City personnel. The cost of any
construction required to be accomplished by City crews
will be in addition to the above fees {see Sec. 28-155 a
para. 8).
(4) In the instance that the actual cost of construction is
less than or greater than the estimated construction
costs, the plan review fee and the engineering fees will

be adjusted accordingly, if appropriate, to accurately
reflect the intent of Sections 1, 2, and 3 of Section 28-155.
Upon preliminary approval of the plans by the City of
Lubbock, the developer may enter into a contract with a
utility contractor to construct the system as so planned;
provided, however, that the construction and installation
of the water mains and sanitary sewer mains, or either of
them, shall be inspected by the City to insure that the
installation is made in accordance with the plans and
City's standard specifications which, in every instance,
shall be part of said installation contract.
When the project is ready for construction and the plat
has been approved by the City, line and grade stakes will
be set by the developer's engineer or surveyor. These
stakes will not be set, however, until the developer's
surveyor has properly staked on the ground with iron pins
all points of curve and tangency, all block corners, and
control points.
The complete and accurate to·scale (1"•100') reproducible
drawings (as·builts), with the seal of the developer's
engineering consultant, reflecting actual constructed
water and sanitary sewer facilities shall be submitted to
the Water Utilities Department for final approval. Final
approved as-built reproducible drawings will become
permanent property of the City of Lubbock.
The developer's contractor shall be responsible for all
water valve and sewer manhole adjustments to utility
lines not yet accepted into the City system. Any adjust-
ments to water valve boxes and sewer manholes that have
been accepted by the City will be made by City forces
based on prices included herein in addition to all other
fees, and will be paid by the developer.
(b) Alternate Method of Providing Utilities Under Private Contract.
The City Water Utilities Engineer may allow city staff to
perform engineering services on water and sewer improvements in
accordance with Sec. 28-157. This alternative, if requested by
the developer, would only be considered on small developments
(less than $10,000.00 in construction costs as estimated by the
city engineering staff using the unit prices herein). With
this alternate method of providing for city utilities under
private contract, the developer will deposit with the Water
Utilities Division six percent (6%) of the engineering estimate
to cover the cost of staking, engineering, and inspection by
city personnel plus the estimated cost of any construction

required to be accomplished by city forces. The final cost and
engineering will be adjusted upon completion of the particular
project to reflect six percent (6%) of the actual contract
cost.
(c) In an effort to preserve the integrity of utility lines and
paved alley ways, the developer shall provide the necessary
sewer and water services to the property line to serve all lots
within that particular subdivision on new construction, and
that does not abut any existing water and/or sewer mains.
Where a new subdivision abuts or is adjacent to existing water
and/or sewer mains the City will make a per lot basis according
to prices included herein.
In the event the developer chooses to make water and sewer
service connections to property adjacent to the developer's
property and which is owned by another party, the cost of those
services shall be paid by the developer and included as part of
the refund contract based on the unit prices included herein
and estimates made by the Water Utilities Division. All
refunds will be made in accordance with Section 28-158.
All ~ater and sewer service connections are to be constructed
to the City of Lubbock's standard. All water and sewer service
connections made, other than new construction, will be made
solely by City forces. On new construction the developer will
be required to install wyes and/or tees for sewer connections.
If water and/or sewer service connections are to be made by
City forces, the service connection fee for each lot within the
subdivision, and where requested for each adjacent property,
must be paid prior to acceptance by the City Council.
(d) No installation of water and sanitary sewer mains will be
accepted by the City of Lubbock at any other location except a
dedicated street, alley, or an easement in favor of the City
which shall be filed of record by the owner of said addition.
(e) Under the private contract method of installation by developers
the valued unit pro rata cost for the water and/or sanitary
sewer facilities shall be the pro rata for the subdivision.
(f) When existing water and/or sewer facilities or mains lying
along one or more sides of the property being platted, the
owners or developers shall pay the City one-half (1/2) of the
valued unit pro rata cost of the existing mains as defined in Sec. 28-154 (a).
SECTION 19. THAT Subsection 28-157(a) of the Code of Ordinances of
the City of Lubbock, Texas, is hereby amended to read as follows:

(a) The engineering work necessary to prepare plans and inspect the
construction required to provide water and/or sewer service may
be done by the City Water Utilities engineering department or
an authorized Water Utilities Division representative.
SECTION 20. THAT Section 28-160 of the Code of Ordinances of the
City of lubbock, Texas, is hereby amended to read as follows:
Sec. 28-160. Unit Prices Used in Calculating Costs of Extensions.
(a) The following prices shall be used as unit prices in calculat-
ing the costs of extensions of water or sewer mains and appur-
tenances under the terms of this article:

Paving repair: Paving repair shall be estimated by the
City of lubbock Water Utilities Engineer with the cost
thereof to be based on current prices of labor and
material.
Mobilization, per each 175.00
The unit prices above shall also include all items not specifi-
cally listed herein which may be necessary to produce a com-
plete job except engineering charges.
For both water and/or sewer mains there shall be added a unit
price in calculating the unit cost of extensions for trench
protection, 5 feet to 10 feet cuts, at $3.50 per linear foot.
Water main and sanitary sewer main installations, if approved,
which require mains and appurtenances of a size and/or configu-
ration not listed above, shall be estimated by the Director of
Water Utilities with the cost thereof to be based on current
prices of labor, equipment and material.
SECTION 21. THAT violation of any provision of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed the amount
provided for in the appropriate Chapter of the Code,of Ordinances.
SECTION 22. THAT should any section, paragraph, sentence, phrase,
clause or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 23. THAT the City Secretary is hereby authorized and
directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
