HomeMy WebLinkAboutOrdinance - 9579-1992 - Amending Chapter 16 Uniform Marking Of Parking Spaces For Diabilities. - 12/17/1992First Reading December 17. 1992 Item 1136 Second Reading January 14. 1993 Item 1110 ORDINANCE NO. 9579 AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK WITH REGARD TO UNIFORM MARKING OF PARKING SPACES FOR PERSONS WITH DI ABILITIES; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FO PUBLICATION. 1 WHEREAS, the City Council having determined that in the best interests ofrthe citizens of the City of Lubbock, it is necessary to make amendments to th Code of Ordinances as hereinafter set out, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, 1s he eby amended by adding a section to be numbered 16-249, which said Section reds as follows: •sec. 16-249. Identification and Dimension Requirements for Designated Parking Spaces for Persons with Disabilities. All parking spaces designated after January 1, 1993, for the exclusive use of vehicles transporting temporarily or permanently disabled persons shall conform to Sections 4.1, 4.6, and 4.30 of the Accessibility Guidelines for Buildings and Facilities promulgated under the Americans with Disabilities Act of 1990 (42 U.S.C. 12101 et. seq.) relating to the number, dimensions, and identification of parking spaces for the disabled." SECTION 2. THAT the Code of Ordinances, City of Lubbock, Texas, is h~reby amended by adding a Section to be numbered 16-250, which said Section rlads as follows: 1 "Sec. 16-250. Parking for Persons with Disabilities, Enforcement ! and Penalties. The penalties and enforcement of requirements regarding park 1 ng for disabled persons shall be as provided for in Article 6675a- 5e.1, Sections 6A(c), 6A(d), and Section 10, Vernon's Texas Civil Statutes. SECTION 3. THAT violation of any provisions of this Ordinances shall be d emed a misdemeanor punishable by a fine not to exceed Two Hundred and No/100 D llars ($200.00) as provided in Section 1-4 of the City Code. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publi- cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
