HomeMy WebLinkAboutOrdinance - 9575-1992 - Adopting Uniform Building Code 1991 - 12/17/1992First Reading December 17, 1992 Item #32 Second Reading January 14, 1993 Item 16 ORDINANCE NO. 9575 AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, ENTITLED "BUILDINGS AND BUILDING REGULATIONS11 BY ADOPTING THE UNIFORM BUILDING CODE, 1991 EDITION; SETTING FORTH GENERAL SPECIFICATIONS FOR BUILDING; DELETING DUPLICATIONS OF REGULATION; SETTING PERMIT AND FEE REQUIREMENTS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Building Board of Appeals has determined that the changes hereinafter made to the Building Code of the City of Lubbock, and to the Uniform Building Code are needed to update and modernize these Codes for the ultimate benefit of the citizens of Lubbock and have recommended these changes to the City Council; and · WHEREAS, the City Council has determined that the changes hereinafter made are to the benefit of the public health, safety and general welfare and are in the best interest of the citizens of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the following named sections of Chapter 6, Article I, of the Code of Ordinances of the City of Lubbock are hereby deleted: Sec. 6-4. Delete entire section. Sec. 6-5. Delete entire section. Sec. 6-6. Delete entire section. Sec. 6-7. Delete entire section. Sec. 6-8. Delete entire section. Sec. 6-9. Delete entire section. Sec. 6-10. Delete entire section. Sec. 6-11. Delete entire section. SECTION 2. THAT the following named sections of Chapter 6, Article II, of the Code of Ordinances of the City of Lubbock are hereby amended as follows: Section 6-16. Amend to read as follows: "Sec. 6-16. Uniform Building Code, 1991 Edition, adopted. (a) The 1991 Edition of the Uniform Building Code as copyrighted in 1991 by the International Conference of Building Officials, Whittier, California, as hereinafter amended in this article, is specifically adopted as the building code of the City of Lubbock, Texas, with the following additions and deletions: 1. Delete Chapter 31; and 2. Add Appendix Chapters 32 and 55. A copy of said Code is attached hereto and incorporated herein as though set out completely in detail. References to the Uniform Building Code in this article shall mean the 1991 Edition. One copy of the 1991 Uniform Building Code shall be filed with the City Secretary and a copy shall be maintained in the office of the Building Official. All such copies, with the amendments thereto, are to be open to public inspection during the business hours of the offices where they are maintained. Section 6-22. §302 Application for Permit. Delete entire section which formerly amended Section 302 of the Uniform Building Code. Section 6-23. §304 is amended by the addition of a third paragraph to read as follows: "(c) Plan Review Fees for Convnercial Permits. When a plan or other data are required to be submitted by Section 302(b)1 a plan review fee shall be paid at the time of acquiring the permit. The plan review fees specified in this subsection are separate fees from the permit fees specified in Section 304(b)1 and are in addition to the permit fees. Where plans are incomplete or changed so as to require additional plan review, an additional plan review fee shall be charged." Section 6-24.1. §307 is amended by the addition of a third paragraph to read as follows: "(c) Inspections for Certificate of Occupancy shall be required prior to issuance whenever: I. There is a change in occupancy class, or 2. When a building has not been inspected throughout within the previous 24 months. A fee for inspections for Certificate of Occupancy and a fee for the certificate shall be submitted to the Building Inspection Department prior to inspection. The fee for inspection of single buildings shall be $100.00 plus $30.00 for the certificate. On projects of multiple buildings, the fees shall be $100.00 for the first building inspected and $30.00 for the first certificate; additional buildings shall be $15.00 each and $10.00 for each additional certificate. Said fees may be adjusted annually pursuant to Section 1-10 of the Code of Ordinances. -2 - Sec. 6-26 §308(d) is amended by deleting §308(d)(l) and by replacing the word "other" in §308(d)(2) with the phrase 'rental-residential'." Section 6-26. §308 is further amended by adding §308(e) and (f) to read as follows: "(e) Liability Insurance shall be required for a homeowner or property owner seeking a permit to build a new residential structure to be used as a residence by the person requesting the permit. (f) Prior to issuance of any type of permit required under this chapter, the building official shall require that homeowners show proof of ownership and/or residency. Documents of proof may include but are not limited to the following: current drivers license, property deeds, tax statements, or utility statements.• Section 6-27. §309(d) is amended by adding a sixth paragraph to read as follows: "6. No building of type V construction that is more than ten years old shall be moved into the city limits of the City of Lubbock unless a licensed engineer certifies that the building is: a) structurally sound; b) in compliance with the City building codes; and c) compatible with the structures in the new location." Section 6-30.2. §511. Accessibility to Toilets and Other Features. Section 511 of Chapter 5 of the Uniform Building Code is hereby deleted and a new Section 511 is added to read as follows: "(a) Sanitation facilities shall meet the accessibility standards set out in Sections 4.16 -4.26 of the Accessibility Guidelines for Buildings and Facilities under the Americans with Disabilities Act of 1990, as amended. (b) Identification and dimension requirements for designated parking spaces for persons with disabilities shall be as provided in Section 16-249 of the Code of Ordinances of the City of Lubbock." -3 - SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Hundred Dollars ($200.00) as provided in Section 6-20 of the Building Code of the City of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
