I AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
TijE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE ND. 1490-M; TO
At-,END ORDINANCE NUMBERS 5307, 6119, 7233, 7233A, 7566, 7832, 9183, AND 9230 BY
DELETING ALL PREVIOUS CONDITIONS FOR C-4 ZONING AND REPLACING WITH AMENDED
C~NDITIONS ON A PORTION OF LOTS 1-A AND 2-A, FIESTA AUTOLAND CENTER ADDITION,
L BB0CK, TEXAS; SUBJECT TO AMENDED CONDITIONS; PROVIDING A PENALTY; PROVIDING
A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.

I WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Conmission for its reconmendation
which was received by the City Council and, after due consideration, the City
Council found that due to changed conditions, it would be expedient and in the
iDterest of the public health, safety and general welfare to make those pro-
posed changes in zoning; and

I WHEREAS, all conditions precedent required by law for a valid amendment
t~ the Zoning Ordinance and Map have been fully complied with, including giv-
irtg notices in compliance with Section 29-29 of the Code of Ordinances, City
of Lubbock, Texas, and the notices provided by the Texas Local Government Code
§J.11.007 (Vernon, 1990), and notice was duly published in the Lubbock c -Journa more than fifteen (15) days prior to the date of the public h aring before the City Council on such proposed amendment, and the public
haring according to said notice, was held in the City Council Chamber of the
M nicipal Building, Lubbock, Texas, at which time persons appeared in support
o the proposal; and after said hearing, it was by the City Council determined tat it would be in the public interest, due to changed conditions, that the
Z ning Ordinance and the Zoning Map be amended in the manner hereinafter set
f rth in the body of this Ordinance and this Ordinance having been introduced
p ior to first reading hereof; NOW THEREFORE:
Bf IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
' ZONE CASE NO. 1490-M
SECTION 1. THAT Ordinance Numbers 5307, 6119, 7233, 7233A, 7566, 7832,
9 83, 9230, and the Zoning Ordinance and the Official Map BE and the same are
h reby amended as follows:
To amend C-4 zoning conditions by repealing the C-4 conditions in
Ordinance Numbers 5307, 6119, 7233, 7233A, 7566, 7832, 9183, and
9230 on a portion of Lots 1-A and 2-A, Fiesta Autoland Center
Addition, City of Lubbock, Lubbock County, Texas, located East of
Slide Road from Loop 289 to 69th Street, and replacing the deleted
conditions with the amended conditions, and being further
described as follows:
METES AND BOUNDS DESCRIPTION for the plat limits of Lots l-A-1 1 2-A-l and 2-A-2, a replat of Lots 1-A and 2-A, SAYE AND EXCEPT the South 475.00 feet thereof, Fiesta Autoland Center Addition to the
City of Lubbock, Lubbock County, Texas, being further described as
follows:
BEGINNING at a railroad spike found which bears S. 89°56' E. a
distance of 172.80 feet from the Northwest corner of Section 10,
Block E-2, Lubbock, Lubbock County, Texas;
THENCE s. 89°56' E. a distance of 242.10 feet to a railroad spike found;
THENCE S. 77•44, E. a distance of 249.60 feet to a 2" steel post
found;
THENCE South a distance of 550.35 feet to a 1/2" iron rod found;
THENCE N. 89°56' W. a distance of 600.00 feet to a 1/2" iron rod
found;
THENCE North a distance of 413.29 feet to a concrete right-of-way
marker found at a point of curvature;
THENCE Northeasterly around a curve to the right, said curve hav-
ing a radius of 215.00 feet, a central angle of 62°, tangent
lengths of 129.18 feet and a chord distance of 221.47 feet to the
POINT OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That the project be tied to the site plan, including build-
ing elevations, approved as Site Plan 1490-M.
b. That a 2 1/2 foot to 3 foot masonry fence shall be main-
tained from Loop 289 to 69th Street (except where curb cuts
are approved) with materials architecturally compatible with
the shopping center.
c. That Slide Road access shall be limited to two (2) curb cuts indicated on the site plan.

d. That the C-4 permitted uses be limited to the following:
1. Any use unconditionally pennitted 1n the C-2A, C-2 or
C-3 Districts.
2. Automobile brake shop.
3. Barber and beauty shop supply dealer.
4. Builders supply. All materials must be in a building.
5. Garden Center.
6. Gasoline service station. (Business permitted outside
of building and outside displays of products permitted
within three (3) feet of the building.
7. Greenhouse and plant nursery.
8. Restaurants. (Business permitted outside of building).
9. Restaurants, with the sale of alcoholic beverages as
an incidental use, except that no mixed alcoholic
beverage sales shall be made or delivered to occupants
in motor vehicles.
10. Sign shops, limited to window lettering, painted wall
signs, banners and desk signs.
11. Veterinary hospital (totally within a building).
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and
No/100 Dollars ($2,000.00) as provided in Section 29-31(a) of the Zoning Ordi-nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary ts hereby authorized to cause publi-
cation of the descriptive caption of this Ordinance as an alternative method
provided by law.

introduced prior to first reading hereof; NOW THEREFORE:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 1708-A
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
amended as follows:
A change of zoning from R-1 to R-1 Spec1f1c Use, under provisions
of Section 29-24(c)(2) of the Code of Ordinances of the City of
Lubbock for garden homes, on Lot 76, Bobalet Heights Addition,
City of Lubbock, Lubbock County, Texas, located at the Southeast
corner of 24th Street and Slide Road, and subject to conditions.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That the units be a minimum of 2,500 square feet.
b. That the units shall be single story only.
c. That the zoning shal 1 be tied to site pl an No. 1708-A as
presented to the Planning and Zoning Commission and signed
by the Chairman on November 5, 1992.
SECTION 2. THAT the granting of this specific use zoning is hereby made
subject to compliance to all provisions of Zoning Ordinance No. 7084, as
amended, including particularly, but not limited to, Section 29-24 of the Cod-
ified Zoning Ordinance, which provides that a Building Permit shall be applied
for and secured within thirty (30) months of the effective date of the zone
change or all undeveloped property shall automatically revert back to the pre-
vious zoning classification, which in this case is the R-1 zone district; and
if such reversion occurs, the Director of Planning is directed to remove from
the Zoning Map the legend indicating such specific use. The Specific Use
authorized by this Ordinance is permitted under provision of Section 29-24
{c)(2) of Codified Zoning Ordinance No. 7084 on the property described as Lot
76, Bobalet Heights Addition, City of Lubbock, Lubbock County, Texas.
SECTION 3. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and
