Reading December 10, 1992 Item #20 Second Reading December 17, 1992 Item 116 ORDINANCE NO. 9571 _,,;..;.........;. __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2411-C; A ZONING CHANGE FROM C-2 AND C-3 SPECIFIC USE TO C-3 ZONING ON A TRACT OUT OF SECTION 11, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT . TO CONDITIONS; PROVIDING A PE~ALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. ! I WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation wh~ch was received by the City Council and, after due consideration, the City Co ncil found that due to changed conditions, 1t would be expedient and in the in erest of the public health, safety and general welfare to make those pro- po~ed changes in zoning; and I ! WHEREAS, all conditions precedent required by law for a valid amendment to! the Zoning Ordinance and Map have been fully complied with, including giv- ing notices in compliance with Section 29-29 of the Code of Ordinances, City ofi Lubbock, Texas, and the notices provided by the Texas Local Government Code §2jll.007 (Vernon, 1990), and notice was duly published in the Lubbock Ay~Janche-Journal more than fifteen (15) days prior to the date of the public he,aring before the City Council on such proposed amendment, and the public heJaring according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support ofi the proposal; and after said hearing, it was by the City Council determined t~at it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set fdrth in the body of this Ordinance and this Ordinance having been introduced p1ior to first reading hereof; NOW THEREFORE: B~ IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I ZONE CASE NO. 2411-C I SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are aliended as follows: A change of zoning from C-2 and C-3 Specific Use to C-3 zoning district, under provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract out of ' Section 11, Block E-2, City of Lubbock, Lubbock County, Texas, located on the East side of the 8000 block of Quaker Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 38,939 square foot tract of land located in Section 11, Block E-2, Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 00°02 1 46" E. a distance of 584.60 feet and N. 89°59 1 4011 E. a distance of 75.00 feet from the Southwest corner of Section 11, Block E-2, Lubbock, Lubbock County, Texas; THENCE N. 00 ° 02 I 46 II E. a distance of 156.00 feet; THENCE N. 89°59 1 4011 E. a distance of 273.76 feet; THENCE S. 00°02 1 46" W. a distance of 77.49 feet; THENCE S. 54°06'30 11 w. a distance of 99.82 feet; THENCE N. 89°59'40" E. a distance of 10.62 feet; THENCE S. 00°02 1 46 11 w. a distance of 20.00 feet; THENCE S. 89°59 1 4011 w. a distance of 203.55 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITION: a. That the zoning be shall tied to site plan No. 2411-C as presented to the Planning and Zoning Commission and signed by the Chairman on November 5, 1992. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-3l(a) of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 - SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
