HomeMy WebLinkAboutOrdinance - 9566-1992 - Amending Chapter 2 Article X Repealing Section 2-270 Through 2-272 - 12/10/1992HW:js First Reading December 10, 1992 Item 1130 Second Reading December 17, 1992 Item 1120 ORDINANCE NO. 9566 ""'-"'------ AN ORDINANCE AMENDING CHAPTER 2, ARTICLE X OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY REPEALING SECTIONS 2-270 THROUGH 2-272 WHICH CREATED AND ESTABLISHED A MUNICIPAL GARDEN AND ARTS CENTER ADVISORY COMMITTEE, AND BY MODIFYING SECTION 2-259 TO ENLARGE THE DUTIES OF THE PARK AND RECREATION BOARD; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. ' WHEREAS, the City Council of the City of Lubbock is considering passage of a Resolution which would revive and reorganize the Lubbock Municipal Arts Committee; and WHEREAS, the City Council of the City of Lubbock has determined that the duties of the Municipal Garden and Arts Center Advisory Committee could be consolidated into the Lubbock Municipal Arts Committee and the Park and Recreation Board, thus eliminating the need for the Garden and Arts Center Committee; and WHEREAS, the City Council deems it to be in the best interest of the citizens of this City to consolidate such duties; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Sections 2-270 through 2-272 of the Code of Ordinances of the City of Lubbock are hereby repealed. SECTION 2. THAT paragraphs (a) and (b) of Section 2-259 of the Code of O~dinances of the City of Lubbock are hereby modified to read as follows: (a) The park and recreation board shall be an advisory board to the City Council and shall make recommendations to the City Council in all matters pertaining to cemeteries, and in the areas of expansion and operational policies as well as all other matters in its opinion necessary, convenient or desirable in order to operate, maintain, enlarge, extend, preserve and promote an orderly, economic, businesslike development of park and recreation facilities and programs and related art items for the city, except the naming of park and recreational areas which shall remain the responsibility of the City Council after receipt of the recommen- dation of the board. (b) The park and recreation board shall have, in addition to the above dut 1 es, the duty to recommend to the C 1 ty Counc 11 such fees as may be necessary to meet the operational expenses of certain park and recreational facilities, including the fees for municipal golf courses, swimming pools, and the Municipal Garden and Arts Center, when it is determined by the City Council that a part or all of the costs of operation of such facilities is to be paid by the users thereof. In addition, the board shall recommend to the City Council contracts for the operation of all concessions located on park land or within recreational facilities. The board shall be further responsible for formulating such rules and regu- lations as may be necessary for the government of their actions, proceedings, and time and place of meetings; however, such rules and regulations shall not be in contradiction of any laws of the state or of any provision of this Code or other ordinance of the City. SECTION 3. THAT the City Council will consider passage of a Resolution which would revive and reorganize the Lubbock Municipal Arts Committee, whose duties would include, among other things, reviewing the exhibition policies of the Lubbock Municipal Garden and Arts Center. SECTION 4. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alterna- tive method provided by law.
