AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
TH CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2402-D; A ZON-
ING CHANGE FROM C-2 AND GO TO R-1 1 60 TO C-2, AND C-2 TO C-3 ZONING ON TRACTS
OUJ OF SECTION 26, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING
A IENALTY; PROVIDING A SAVINGS CLAUSE ANO PROVIDING FOR PUBLICATION.

I i WHEREAS, the proposed changes in zoning as hereinafter made have been
du y presented to the Planning and Zoning Commission for its recommendation
wh ch was received by the City Council and, after due consideration, the City Co ncil found that due to changed conditions, it would be expedient and in the
in erest of the public health, safety and general welfare to make those pro-
po ed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, including giv-
in notices in compliance with Section 29-29 of the Code of Ordinances, City
of Lubbock, Texas, and the notices provided by the Texas local Government Code
§2 1.007 (Vernon, 1990), and notice was duly published in the Lubbock
Ay~lanche-Journal more than fifteen (15) days prior to the date of the public
heEring before the City Council on such proposed amendment, and the public
hearing according to said notice, was held in the City Council Chamber of the
Municipal Building, Lubbock, Texas, at which time persons appeared in support
ofj the proposal; and after said hearing, it was by the City Council determined
t~at it would be in the public interest, due to changed conditions, that the
Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set
forth in the body of this Ordinance and this Ordinance having been introduced
p ior to first reading hereof; NOW THEREFORE:
B IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:

SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
a ended as follows:
A change of zoning from c ... 2 and 60 to R-1 1 GO to C-2, and C-2 to C-3
zoning district, under provisions of Section 29-29 of the Code of Ordi-
nances of the City of Lubbock, on tracts out of Section 26, Block E-2,
City of Lubbock, Lubbock County, Texas, located Southeast of 82nd Street
and Frankford Avenue, subject to conditions and being further described
as follows:
METES AND BOUNDS DESCRIPTION for three (3) tracts in Section 26, Block
E-2, Lubbock, Lubbock County, Texas, being further described as follows:
TRACT ONE
BEGINNING at a point which bears South approximately 225.00 feet and
East approximately 55.00 feet from the Northwest corner of Section 26,
Block E-2, Lubbock, Lubbock County, Texas;
THENCE East an approximate distance of 1,180.00 feet;
THENCE South an approximate distance of 265.00 feet:
THENCE West an approximate distance of 1,180.00 feet;
THENCE North an approximate di stance of 265.00 feet to the POINT OF
BEGINNING.
CONTAINS: 7.18 acres
TRACT TWO
BEGINNING at a point which bears South approximately 55.00 feet and East
approximately 1,105.00 feet from the Northwest corner of Section 26,
Block E-2, Lubbock, Lubbock County, Texas;
THENCE East an approximate distance of 140.00 feet;
THENCE South an approximate distance of 170.00 feet;
THENCE West an approximate distance of 140.00 feet;
THENCE North an approximate distance of 170.00 feet to the POINT OF
BEGINNING.
CONTAINS: 0.55 of an acre

TRACT THREE
BEGINNING at a point which bears South approximately 55.00 feet and East
approximately 55.00 feet from the Northwest corner of Section 26, Block
E-2, Lubbock, Lubbock County, Texas;
THENCE East an approximate distance of 460.00 feet;
THENCE South an approximate distance of 170.00 feet;
THENCE West an approximate distance of 460.00 feet;
THENCE North an approximate distance of 170.00 feet to the POINT OF
BEGINNING.
CONTAINS: 1.80 acres
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That Tract One is changed from C-2 and GO to R-1 zoning;
b. That Tract Two is changed from GO to C-2 zoning, subject to
the following additional condition:
1. That a site plan, including building elevations showing
materials, color, and texture, shall be submitted and
approved by the Planning and Zoning Commission prior to the
issuance of a building permit on the property.
c. That Tract Three is changed from C-2 to C-3 zoning, subject to the
following additional condition:
1. That a site plan, including building elevations showing
materials, color, and texture, shall be submitted and
approved by the Planning and Zoning Commission prior to the
issuance of a building permit on the property.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 29-3l(a) of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method
provided by law.
AND IT IS SO ORDERED.
