HomeMy WebLinkAboutOrdinance - 9558-1992 - Closing Transformer Pad Easement Pheasant Run Addition - 10/22/1992• ... -I HW:js 36884 File And Return T6 Ed Bucy R-0-W First Reading October 22, 1992 Item i/12 Second Reading November 12, 1992 Item i/12 VOL 4Q36PAGE 34 ORDINANCE NO. 9558 AN ORDINANCE ABANDONING AND CLOSING A TRANSFORMER PAD EASEMENT LOCATED IN PHEASANT RUN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY · ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the transformer pad easement as hereinafter described in the body of this Ordinance is no longer needed for public use. and it would be in the public interest to close, vacate and aban- don the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the transformer pad easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for the public use, said easement being more particularly described as follows: A transformer pad easement located on Lot 285, Pheasant Run Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 89°58'17" W. a distance of 3.07 feet from the Northeast corner of Lot 285, Pheasant Run Addition to the City of Lubbock, Lubbock County, Texas; THENCE S. 12°18'04" E. a distance of 6.00 feet; THENCE S. 77°41 1 56" W. a distance of 4.00 feet; THENCE N. 12°18 1 04" W. ·a distance of 6.87 feet; THENCE S. 89°58'17" E. a distance of 4.09 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing. showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase. clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. .. .,.. • ., VOL (Q36PAGE 35 SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
