HomeMy WebLinkAboutOrdinance - 9551-1992 - Amending Section 28-52, 28-53, 28-54, 28-55, 28-56, 28-59(D) ETC.. - 08/27/1992First Reading August 27, 1992 Item #19 Second Reading September 10, 1992 Item f/:15 ORDINANCE NO. 9551 AN ORDINANCE AMENDING SECTIONS 28-52, 28-53, 28-54, 28-55, 28-56 AND 28-59(d) OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK BY REVISING WATER RATES AS CONTAINED IN SECTIONS 28-52 AND 28-53 OF SAID CODE; ADJUSTING THE WATER RATES CHARGED UNDER SECTION 28-54 APPLICABLE TO TEXAS TECH UNIVERSITY TO CONFORM WITH NEW SCHOOL RATES APPLICABLE TO ALL SCHOOLS; AND BY REVISING THE RATES SET FORTH IN SECTION 28-59(d) BY ESTABLISHING THE COMMERCIAL RATE AS THE RATE TO BE USED IN SAID SECTION IN COMPUTING THE WHOLESALE WATER RATE (81.17%) TO BE CHARGED TO THE TOWN OF RANSOM CANYON AND TO LUBBOCK COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. l; REQUIRING PUBLICATION AND PROVIDING FOR A SAVINGS CLAUSE. WHEREAS, there is a need to provide for and adopt new water rates for the City of Lubbock that will encourage conservation of the water supply; and WHEREAS, such new rates as hereinafter set forth will encourage such conservation; and WHEREAS, such new rate system is in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-52 of the Code of Ordinances of the City of Lubbock pertaining to water rates BE and is hereby amended to read as follows: Section 28-52. Base Rate. SECTION 2. THAT Section 28-53 of the Code of Ordinances of the City of Lubbock pertaining to water rates BE and is hereby amended to read as follows: Section 28-53. Rates Generally. The City, through its water department, shall charge to and collect from every consumer and every consumer shall pay for water furnished by the City to the consumer, the amount calculated by application of the following rates, in addition to the base rate, to meter readings for all billing cycles beginning on the dates hereinafter set forth: Single Family Residence Multiple Family Commercial Schools Sprinkler Reese A.F.B. THAT Section 28-54 of the Code of Ordinances of the City of Lubbock pertaining to water rates charged to Texas Tech University BE and is hereby amended to read as follows: Section 28-54. Texas Tech University. The rate for water supplied to Texas Tech University shall be the same rate as established for and applicable to schools in Sections 28-52 and 28-53 of the Code of Ordinances of the City of Lubbock. SECTION 4. THAT Section 28-55 of the Code of Ordinances of the City of Lubbock pertaining to water rates charged to Lubbock Christian University BE and is hereby amended to read as follows: Section 28-55. Lubbock Christian University. The rate for water supplied to Lubbock Christian University shall be the same rate as established for and applicable to schools in Sections 28-52 and 28-53 of the Code of Ordinances of the City of Lubbock. - 2 - SECTION 5. THAT Section 28-56 of the Code of Ordinances of the City of Lubbock pertaining to water rates charged to the Buckner Baptist Home BE and is hereby amended to read as follows: Section 28-56. Buckner Baptist Home. The rates for water supplied to the Buckner Baptist Home shall be the same rate as established for and applicable to Multiple Family in Sections 28-52 and 28-53 of the Code of Ordinances of the City of Lubbock. SECTION 6. THAT Section 28-59(d) of the Code of Ordinances of the City of Lubbock pertaining to water rates charged to the Town of Ransom Canyon and Lubbock County Water Control and Improvement District No. 1 BE and is hereby amended to read as follows: Section 28-59(d). Town of Ransom Canyon and Lubbock County Water Control and Improvement District No. 1. (d) The City Council approves and accepts the methodology of determining the City's cost of providing services to the Town of Ransom Canyon and Lubbock County Water Control and Improvement District No. 1 as described in the report prepared by Freese & Nichols, the City's consulting engineers, dated June, 1988; and based upon the methodology set forth in such report the City Council adopts the initial rates for providing services to the Town of Ransom Canyon and Lubbock County Water Control and Improvement District No. 1 as follows: Eighty-one and seventeen-hundredths (81.17) percent of the rate established for "commercial" as set forth in Section 28-53 of the Code of Ordinances of the City of Lubbock. In addition, there shall be added to such rate the proportionate costs of installing capital improvements necessary to furnish such water which shall be repaid over a period of thirty (30) years on either an annual or monthly basis at six and one half (6%) percent simple interest. SECTION 7. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. - 3 - AND IT IS SO ORDERED. Single phase motors not to exceed 10 horsepower, individual capacity, may be served under this rate. TERRITORY: Lubbock, Texas TERMS OF PAYMENT: 21 discount deducted from all residential bills if paid within 16 days after mailing date. An additional 11 will be deducted from residential bills if these bills are paid by bank draft. 51 added to bill after 22 days. RATE: Tariff Number 1.0 Service Availability Charge: $4.66 per month. All Kwh per month@ 3.93¢ per Kwh. ELECTRIC LIVING SERVICE Tariff Number 1.1 Water Heating -When customer has in regular use a permanently installed 240 volt, 30 gallons or greater, storage type water heater of not greater than 5.5 kilowatts, individual rated capacity, the first 500 Kwh will be billed at the regular rate, the next 500 Kwh at 1.58¢ per Kwh, and all additional Kwh at the regular rate. The regular rate for qualifying head of household at least 65 years of age will be Tariff Number 1.4. Tariff Number 1.2 All-Electric Space Heating -When customer has in regular use permanently installed space heating equipment of an aggregate rate capacity of 3 kilowatts or more, excluding bathroom heaters, billing during the winter months will be the first 500 Kwh at the regular rate, and all additional Kwh at .86¢ per Kwh. When customer has water heating in combination will all- electric space heating, the first 500 Kwh will be billed at the regular rate, the next 500 Kwh at 1.58¢ per Kwh and all additional Kwh at .86¢ per Kwh. The regular rate for qualifying head of household at least 65 years of age will be Tariff Number 1.4. Tariff Number 1.3 Add on Heat Pump -When customer has in regular use a permanently installed heat pump used as the primary heat source for the entire residence in conjunction with a gas or oil fired furnace for extreme cold weather back-up, billing during the winter months will be first 600 Kwh at the regular rate and additional Kwh at .86¢ per Kwh. When customer has water heating in combination with the add on heat pump, the first 600 Kwh will be billed at the regular rate, the next 500 Kwh at 1.58¢ per Kwh and all additional Kwh at .86¢ per Kwh. The regular rate for qualifying head of household at least 65 years of age will be Tariff Number 1.4. The rated capacity of space heating equipment may be measured by Lubbock Power and Light. Tariff Number 1.4 (Senior Citizen Residential Rate) When the qualifying head of household is at least 65 years of age and whose monthly usage is 600 Kwh or less. The following factors will apply: Service Availability Charge: $4.20 per month All Kwh per month at 3.33¢ per Kwh. If the monthly usage is over 600 Kwh per month, Tariff Number 1.0 will apply. WINTER MONTHS: The billing months of November through April, inclusive. FUEL COST RECOVERY: The charge per kilowatt hour of the above rate shall be increased by a fuel factor per kilowatt hour as provided in current Southwestern Public Service Tariff 7100. TAX ADJUSTMENT: Billings under this schedule may be increased by an amount equal to the sum of the taxes payable under federal, state, and local sales tax acts, and of all additional taxes, fees, or charges, (exclusive of ad valorem, state and federal income taxes) payable by the utility and levied or assessed by any governmental authority on the public utility services rendered, or on the right or privilege of rendering the service, or on any object or event incidental to the rendition of service, as the result of any new or amended laws after June 30, 1965. AVERAGED BILLING PLAN: Upon request, any customer whose average monthly bill is $25.00 or more, may be billed monthly, based on his average bill (estimated if applicable), plus a portion of any unbilled balance. customers having delinquent or disputed bills are not eligible for billing under this plan. CHARACTER OF SERVICE: A-C; 60 hertz; single phase 120/240 volts; where available on secondary, three phase 240 volts.
