August 27, 1992 397"' .326 Item #22 fDt. ,PACI Second Reading · September 10, 1992 Item #12 ORDINANCE NO. 9548 AN ORDINANCE AUTHORIZING RATIFICATION AND CONFIRMATION OF ACCESS EASEMENT IN GIFFORD-HILL ADDITION REPLAT BY CITY OF LUBBOCK IN EXCHANGE FOR CONVEYANCE TO CITY OF LUBBOCK OF CERTAIN PROPERTY. WHEREAS, the City Council of the City of Lubbock finds it would be to the public interest to ratify and confirm an Access Easement in favor of the owner of Lot 2E of the replat of Lot 2, Gifford-Hill Addition to the City of Lubbock, Lubbock County, Texas, in exchange for owner of said Lot 2E, conveying by warranty deed to the City of Lubbock in exchange therefor 1.424 acres adjoining parkland owned by the City of Lubbock pursuant to Section 253.001 of the Local Government Code of the State of Texas; NOW THEREFORE: SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized and dil'ected to execute for and on behalf of the City of Lubbock a ratification and confirmation document in the form and substance as referred to and described in the preamble of this Ordinance, attached herewith, which shall Qe spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Ordinance as if fully copied herein in detail. SECTION 2. THAT said ratification and confirmation instrument shall be exchanged by the Right-of-Way Department of the City of Lubbock for the warranty deed to be executed by the owner of said Lot 2E of the replat as aforesaid. First Reading August 27, 1992 Item #22 VOL 3977 PAC£327 Second Reading September 10, 1992 Item #12 RATIFICATION AND/OR CONFIRMATION OF ACCESS EASEMENT BY CITY OF LUBBOCK STATE OF TEXAS § COUNTY OF.LUBBOCK § WHEREAS, there was shown on the plat or map of the r~plat of property described in Dedication Deed filed at Page 2592, Page 45 of the Official Real Property Records of Lubbock County, Texas, outside of limits of said replat an easement shown as "ACCESS EASEMENT" being across land owned by the City of Lubbock, and the City of Lubbock did not join in said replat of said property as an owner dedicating said replat, said replat impressed the name of "Lots 2A through 2G, a replat of Lot 2, Gifford-Hill Addition to the city of Lubbock, Lubbock County, Texas••; and WHEREAS, in order to remove any question about the validity of said "ACCESS EASEMENT" which lies immediately south of Lot 2E of said replatted property, the City of Lubbock finds it to the best interest of said City to ratify and confirm said Access Easement as shown on the plat or map of said replat, as if the City of Lubbock fully joined in said replat originally to the extent necessary to grant to the owner of Lot 2E of said replat, the right of access across said property owned by the City of Lubbock as shown on the plat or map of said replat. Said Replat and the documents filed in connection therewith of record as aforesaid, are eby incorporated herein in detail in this place as if fully opie erein · detail and made a part hereof for all purposes.
