HomeMy WebLinkAboutOrdinance - 9547-1992 - Zmending Chapter 29 Amending Zoning Ordinance 29-31 - 08/27/1992First Reading August 27, 1992 Item #15 Second Reading September 10, 1992 Item Ill ORDINANCE NO. 9547 AN ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ZONING BY AMENDING SECTION 29-31 WITH REGARD TO PENALTIES; PROVIDING A SAVINGS CLAUSE; ANO PROVIDING FOR PUBLICATION. WHEREAS, the proposed amendment to the Zoning Ordinance as is here- inafter made has been duly presented to the Planning and Zoning Commission for its recommendation. The City Council finds that it would be expedient and in the interest of the public health, safety and general welfare to so amend said Zoning Ordinance; and WHEREAS, Article 4.14 of the Code of Criminal Procedure of the State of Texas has been amended to provide for imposition of fines up to two thousand dollars ($2,000.00) per day by Municipal Courts for violation of ordinances pertaining to zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance have been fully complied with, as well as giving notice in compliance with Section 29-29 of the Code of Ordinances of the City of Lubbock, Texas, as well as notices provided for by the Local Government Code, Section 211.007, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was held in the City Council Chambers of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, it would be in the public inter- est that the Zoning Ordinance be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been intro- duced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 29-31 of the Code of Ordinances, City of Lubbock, Texas, be amended, is hereby amended to read as follows: Sec. 29-31. Penalties for violations. (a) Any person, landowner, building owner or occupant, who shall violate any of the provisions of this ordinance (chapter) or who shall fail to comply with any of the provisions of this ordinance (chapter) or who shall build, alter, or occupy any building, struc- ture of land in violation of any statement of plan submitted and approved hereunder shall be guilty of a misdemeanor and upon convic- tion thereof shall be fined in any sum not to exceed two thousand dollars ($2,000.00) or such other amount as may be provided by the general laws of the State of Texas for such offenses. Each day such violation is committed or permitted to continue shall constitute a separate offense, and shall be punishable as such hereunder. {b) The owner or owners of any building or property or part thereof where anything in violation of this ordinance (chapter) shall be placed or shall exist and any architect, building contractor, agent, attorney, person, firm, or corporation employed in connection therewith and who have assisted in the commission of such violation shall be guilty of a separate offense, and upon conviction thereof, shall be fined in any amount not to exceed two thousand dollars ($2,000.00) or such other amount as may be provided by the general laws of the State of Texas for such offenses. (c) In addition to the remedies provided for above, the administrator may, in case any buildings or structures are erected, constructed, reconstructed, altered, repaired, converted, or main- tained, or any building, structure or land is used in violation of this ordinance (chapter), institute on behalf of the City of Lubbock any appropriate action or proceedings to prevent such unlawful erec- tion, construction, reconstruction, alteration, repair, conversion, maintenance, or use, to restrain, correct or abate such violation, to prevent any illegal act, conduct of business or use in or about such premises. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
