HomeMy WebLinkAboutOrdinance - 9545-1992 - Zone Case 2690 Zoning Change R-1 To A-2 Zoning Tract - 08/27/1992LLC:js First Reading August 27, 1992 Item 113 Second Reading Apri•l 14, 1994 .Item #7 ORDINANCE NO. 9545 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2690; A ZONING CHANGE FROM R-1 TO A-2 ZONING ON A TRACT OUT OF SECTION 44, BLOCK A-K, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those pro- posed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giv- ing notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 {Vernon, 1990}, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15} days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2690 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning from R-1 to A-2 zoning district, under provi- sions of Section 29-29 of the Code of Ordinances of the City of Lubbock, on a tract out of Section 44, Block A-K, City of Lubbock, Lubbock County, Texas, located West of West Loop 289, East of Iola Avenue and South of 24th Street, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 16.875 acre tract of land out of Section 44, Block A-K, Lubbock, Lubbock County, Texas, and being further described as follows: BEGINNING at a point in the West line of the Northeast 1/4 of Sec- tion 44, Block A-K, for the beginning corner of this tract, whence the Northwest corner of the Northeast 1/4 of Section 44, Block A- K, bears North a distance of 1953.87 feet; THENCE South, a distance of 686.13 feet to a found 3/8" iron rod, the Southwest corner of this tract; THENCE East, a distance of 1175.69 feet to a 3/8" iron rod, in the West R.O.W. line of Loop 289, for the Southeast corner of this tract; THENCE N. 00°03 1 30" East, along the West R.O.W. line of Loop 289, a distance of 589.72 feet to a point, the East-Northeast corner of this tract; THENCE Northwesterly, along the arc of a curve to the left, an arc distance of 23.58 feet to the point of tangency of said curve, said curve has a radius of 15.00 feet, a central angle of 90°03 1 30" and a chord that bears North 44°58 1 15" West, a distance 21.21 feet; THENCE West, a distance of 681.63 feet to a 3/8" iron rod, set for the point of curvature of a curve to the right; THENCE Northwesterly, along the arc of a curve to the right, an arc distance of 250.58 feet to the point of compound curvature of a curve to the left, said curve has a radius of 574.06 feet, a central angle of 25°00 1 34 11 and a chord that bears North 77°29 1 43" West, a distance of 248.59 feet; THENCE Northwesterly, along the arc of a curve to the left, an arc distance of 198.20 feet to the point of compound curvature of a curve to the left, said curve has a radius of 454.07 feet, a cen- tral angle of 25°00 1 34" and a chord that bears North 77°29 1 43" West, a distance 196.63 feet; THENCE Southwesterly, along the arc of a curve to the left, an arc distance of 23.56 feet to the point of tangency of said curve, said curve has a radius of 15.00 feet, a central angle of 90°00 1 0011 and a chord that bears S. 45°00 1 00" W. a distance of 21.21 feet; THENCE West a distance of 30.00 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: a. That the buildings shall be set back a minimum of 100 feet from Iola. - 2 - b. That concurrent with the final plat, 26th Street shall be dedicated full width and the improvement expense shall be provided by the developer of the tract. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed One Thousand and No/100 Dollars ($1,000.00) as provided in Section 29-31(a) of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. Passed by City Council on 1992.
