AN ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANC
OF THE CITY OF LUBBOCK. TEXAS .. BY REPEALING ARTICLE VII THEREOF
ENTITLED "EIRE PREVENTION CODE"; PROVIDING FOR ADOPTION OF THE
1971-72 EDITION .OF THE NATIONAL FIRE CODES; PROVIDING FOR AUTHOR!
OF THE FIRE MARSHAL; PROVIDING A PENAI3TY; PROVIDING A SAVINGS
CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has found that the pre-
1 sent Fire Prevention Code of the City of Lubbock has become obsolete and ina'Cie-
quate; and,
WHEREAS, the City Council has found that the National Fire Codes, 1971-
72 Edition, should be adopted; NOW THEREFORE:
SECTION 1. THAT the present Article VII of Chapter 12 of the Code of
Ordinances of the City of Lubbock, Texas, BE and is hereby repealed.
SECTION 2. THAT a new Article VII of Chapter 12 of the Code of Ordin-
ances of the City of Lubbock .. Texas, BE and is hereby adopted and shall read as
follows:
Article VII National Fire Code
Section 12-82. National Fire Codes -Adopted.
The 1971-72 Edition of the National Fire Codes, in
10 volumes, as compiled and recommended by the
National Fire Protection Association, Boston,
Massachusetts, is specifically adopted as the National
Fire Code of the City of Lubbock, Texas, and a copy
is attached hereto and incorporated herein by refer-
ence as though set out completely in detail. A copy of
said National Fire Code shall be filed with the city sec-
retary and a copy maintained in the office of the fire
marshal of the City of Lubbock, Texas, and all such
copies shall be open to public inspection during busi-
ness hours of the offices where they are situated.
Section 12-8. Authority ~f fire marshal.
Whenever in the National Fire Code, 1971-72 Edition,
as adopted .. it is provided that anything must be done
to the approval of, or subject to the direction of, the
fire marshal, this shall be construed to give such
officer only the discretion of determiniFlg whether1he
rules and standards established by this code has been
complied with; and no such provision shall be construed
as giving any officer discretionary powers as to what
such regulations o~ standards shall be, or power to
require conditions not prescribed by the code or to
enlbrce code provisions in an arbitrary or discrimmin-
atory manner.
Section 12 ... 8. Penalty.
Any person violating, or failing to comply with, any
provision of the National Fire Code, 1971-72. Edition,
as adopted shall be deemed guilty of a misdemeanor
and, upon conviction thereof, shall be fined an amount
not exceeding two hundred {$200. 00) dollars.
SECTION 3. THAT should any section, paragraph, sentence, clause, phr e
or word of this Ordinance be declared unconstitutional or invalid for any reason, t e
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method pro ...
vided by law.
