HomeMy WebLinkAboutOrdinance - 6265-1971 - Zoning Change-Case 1786, Lots 481-515, University Pine Addition - 12/22/1971ORDINANCE NO. ..=.:62;;.::6;.:;,5_-+- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLWING CHANGE: ZONE CASE NO. 1786: CHANGE LOTS 4.at THROOOH 515, UNIVERSITY PINES ADDITION, CITY OF LUBBOCK, LUB- BOCK COUNTY, TEXAS, FROM AN "R-1" TO AN ''R-2" ZONING DISTRICT AND LOT 516, UNIVERSITY PINES ADDinON, LUBBOCK COUNTY, TEXAS, FROM AN ''R-1" TO A "C-2" ZONING DISTRICT; SUBJECT TO CONDITION; PROVIDING A PENALTY; PROVIDING A SAVING CLAUSE AND PR.OVIDI~ FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommenda- tion, which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695, as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanch Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in sup- port of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner herein- after set forth in the body of this Ordinance and this Ordinance having been intoduced prior to first reading hereof; NOW, THEREFORE: BE IT ORDt\lNED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO, 1786 Change Lots 48t through 515, University Pines Addition to the City of Lubbock, Lubbock County, Texas, from an "R-1" to an "R-2" Zoning District and Lot 516, University Pines Addition, Lubbock County, Texas, from an "R-1" to a "C-2" Zoning r District. Lots 48~ through 515 and Lot 516, as shown on the preliminary plat of University Pines Addition, on file in the office of the Secretary of the Planning and Zoning Commission. SUBJECT TO THE FOLL<:MING CONDITION: (LOT 516 ONLY) That a solid. permanent type acreening fence of wood or masonry. 6 feet in height, be erected and permanently .. intained on the north and vest propert lines of Lot 516. SECTION 2. THAT froa and after paesase and effective data of this Ordi- nance said lots, traets and parcels of land described in Section 1 hereof shall be changed to the Zoniag District inditlted and the Official Map is amended in accordance h.rewith. SECTION 3. THAT any person, firm or corporation owning or operating the subject property failing to ca.ply with the conditions iapoaed by Section 1 hereof shall be guilty of a 11isd&11111anor and upon conviction thereof, shall be subject to a fine not to exceed TWO HtJNDllBD DOI.LARS and each and every 4ay'a violation thereof shall constitute a separate and iistiuct offenee. The failure of any corporation owning or operating the subject property to comply with any of the conditiona iapoaed by Section 1 hereof shall render the President, Vice-President, General Manager, Local Manager and Local gent liable to the penalty prescribed in this section. SECTION 4. THAT should any paragraph, sentence, clauae, phrase or rd of thia Ordinance be declared unconstitutional or invalid for any reason the r ... inder of thia Ordinance shall not be affected thareby.
