ORDINANCE NO. 9508 ----
AN ORDINANCE AMENDING SUBDIVISION 25-6(A)(l)(P) OF CHAPTER 25 OF THE
CODE OF ORDINANCES OF THE CITY OF LUBBOCK SO AS TO ADD ELEVATION REQUIRE-
MENTS IN FLOOD HAZARD AREAS AS REGARDS BUILDING CONSTRUCTION; PRESCRIBING A
PENALTY FOR VIOLATION OF THIS ORDINANCE; PROVIDING FOR PUBLICATION AND
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council finds it is in the interest of the public
health, safety, and welfare to amend the Subdivision Regulations of the City
of Lubbock to set forth elevation requirements as regards building construc-
tion in flood hazard areas; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Subdivision 25-6(A)(l)(P) of Chapter 25 of the Code
of Ordinances of the City of Lubbock is hereby amended in its entirety to
read hereafter as follows:
P. Flood Hazard Areas
(1) When any portion of a proposed plat contains a lake or flood
area that is identified on the Federal Emergency Management
Agency flood hazard maps, notice shall be printed on the face of
the final plat that, "A portion of the above surveyed property
is within the boundary of a Special Flood Hazard Area as
established by the Federal Emergency Management Agency. Flood
hazard maps are on file in the Engineering Office of City Hall,
Lubbock, Texas, for public inspection."
(2) If any property described by the proposed final plat is in an
area influenced by a playa lake, which may be in a Special Flood
Hazard Area as defined by the Federal Emergency Management
Agency, the following statement shall be placed on the face of
the final plat: "Any building construction shall have the
lowest floor, including basement, constructed at a minimum
elevation of the Base Flood Elevation as shown on the City's
Flood Insurance Rate Map, plus one (1) foot; .ru: the High Water
Level established by the City Engineer (calculated assuming
fully developed conditions) plus two (2) feet; whichever is
higher."
(3) If any property described by the proposed final plat is in an
area delineated as a Special Flood Hazard Area that is an
overflow route between lake areas, the following statement shall
be placed on the face of the final plat: "Any building
construction in the Special Flood Hazard Area shall have the
lowest floor, including basement, constructed at a minimum
elevation of the Base Flood Elevation as shown on the City1 s
Flood Insurance Rate Map, plus one (1) foot; gr to an elevation
established by the City Engineer; whichever is higher."
SECTION 2. THAT any person, landowner, building owner, or occupant
who shall violate any of the provisions of said Subdivision 25-6(A)(l)(P)
(as above amended) in the manner set forth in Subdivision 25-S(B) of Chapter
25 of the Code of Ordinances of the City of Lubbock shall be fined in any
sum not to exceed TWO HUNDRED DOLLARS ($200.00) as provided in said
Subdivision 25-S(B).
SECTION 3. THAT the City Secretary shall publish the descriptive
caption and penalty clause of this Ordinance (as set forth in Section 2
next-above) once a week for two consecutive weeks as an alternative means of
publication, and this Ordinance shall become effective ten days after its
last publication.
