TION 29-28 ENTITLED 11ZONING BOARD OF ADJUSTMENT" AT SECTIONS 29-28(f)(2)j AND
29-28(f)(2)n PROVIDING FOR SPECIAL EXCEPTIONS RELATING TO OUTSIDE SALES ACTIV-
1 ITIES AND DANCE FLOORS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND
PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the City
Council finds that due to changed conditions, it would be expedient and in the
interest of the public health, safety and general welfare to make those pro-
posed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giv-
ing notices in compliance with Section 29-29 of the Code of Ordinances, City
of Lubbock, Texas, and the notices provided by the Texas Local Government Code
§211.007 (Vernon, 1990), and notice was duly published in the Lubbock
Avalanche-Journal more than fifteen (15) days prior to the date of the public
hearing before the City Council on such proposed amendment, and the public
hearing according to said notice, was held in the City Council Chamber of the
Municipal Building, Lubbock, Texas, at which time persons appeared in support
of the proposal; and after said hearing, it was by the City Council determined
that it would be in the public interest, due to changed conditions, that the
Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set
forth in the body of this Ordinance and this Ordinance having been introduced
prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Code of Ordinances, City of Lubbock, Texas, is
hereby amended by adding a Section, to be numbered 29-3(52c), which Section
shall read as follows:
11 (52c) Grand Opening: A promotional activity for a new business
permitted by the Codes Administrator for a period not to exceed
sixteen (16) days. A business shall not have more than one (1)
grand opening. The Permittee shall be responsible for properly
anchoring objects."
SECTION 2. THAT Section 29-7(c)(S)c of the Code of Ordinances, City of
Lubbock, Texas, is hereby deleted.
SECTION 3. THAT Section 29-S(k) of the Code of Ordinances, City of
Lubbock, Texas, is hereby deleted.
SECTION 4. THAT Section 29-9(c)(3) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
11 (3) Row dwellings and townhouses which meet the development
standards as provided in the 'Specific Use' Section 29-24(c)(2) of
the Ordinance [Chapter]."
SECTION 5. THAT Section 29-16(l)(l)j.2 of the Code of Ordinances, City
of Lubbock, Texas, is hereby deleted.
SECTION 6. THAT Section 29-20(m)(l)c.26 of the Code of Ordinances, City
of Lubbock, Texas, is hereby deleted.
SECTION 7. THAT Section 29-22(d)(l) of the Code of Ordinances, City of
Lubbock, Texas, is hereby deleted.
SECTION 8. THAT Section 29-23(c)(6) of the Code of Ordinances, City of
Lubbock, Texas, is hereby deleted.

SECTION 9. THAT Section 29-23(d)(l) of the Code of Ordinances, City of
Lubbock, is hereby amended to read as follows:
"(l) Any use conditionally permitted in the M-1 District."
SECTION 10. THAT Section 29-23.l(e)(l) of the Code of Ordinances, City
of Lubbock, Texas, is hereby amended to read as follows:
"(1) Front Yard. The minimum front yard shall be forty-three
(43) feet, or no less than the average setbacks established by the
development on the adjacent lot or lots. The setback on vacant
adjacent lots shall be forty-three (43) feet. This Section shall
not be construed to permit obstructions of any nature on corner
lots within the visibility triangle as defined in Section 29-
30(b)(6)i.2."
SECTION 11. THAT Section 29-23.2(e)(l) of the Code of Ordinances, City
of Lubbock, Texas, is hereby amended to read as follows:
"(l) Front Yard. The minimum front yard shall be forty-three

SECTION 12. THAT Section 29-23.2(c)(50) of the Code of Ordinances, City
of Lubbock, Texas, is hereby deleted.
SECTION 13. THAT Section 29-23.2(1)(1) of the Code of Ordinances, City
of Lubbock, Texas, is hereby amended to read as follows:
"(l) Off-street parking-required. C-2A, C-2, C-3, and C-4 uses
shall meet the requirements of their respective districts."
SECTION 14. THAT Section 29-23.2(1)(2) of the Code of Ordinances, City
of Lubbock, Texas, is hereby deleted.
SECTION 15. THAT Section 29-23.3(e)(l) of the Code of Ordinances, City
of Lubbock, Texas, is hereby amended to read as follows:

of Lubbock, Texas, is hereby deleted.
SECTION 18. THAT Section 29-23.3(1}(3) of the Code of Ordinances,
of Lubbock, Texas, is hereby deleted.
SECTION 19. THAT Section 29-23.3(1)(4} of the Code of Ordinances,
of Lubbock, Texas, is hereby deleted.
SECTION 20. THAT Section 29-23.3(1)(5) of the Code of Ordinances,
of Lubbock, Texas, is hereby deleted.
SECTION 21. THAT Section 29-23.3(1)(6) of the Code of Ordinances,
of Lubbock, Texas, is hereby deleted.

SECTION 22. THAT Section 29-24(c)(l)b of the Code of Ordinances, City of
Lubbock, Texas, is hereby deleted.
SECTION 23. THAT the Code of Ordinances, City of Lubbock, Texas, 1s
hereby amended by adding a section to be numbered 29-24(c)(5)b, which Section
shall read as follows:
"b. Self-service gasoline sales."
SECTION 24. THAT Section 29-24(c}(28) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
11 (28} Blood banks and blood plasma centers. In AM, C-2A, C-2,
C-3, C-4, IHC, IHI, M-1, and M-2 zoning districts. Required off-
street parking --One (1) space for each one hundred (100) square
feet of gross floor area."
SECTION 25. THAT Section 29-24(c)(30) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"(30) Rescue missions, shelters for the homeless, and other types
of transient housing excluding community based shelters as defined
in Section 29-3(26a). In the A-2, C-4, IOP, IHC, IHI, M-1, and M-
2 zoning districts. Required off-street parking --One (1} space
for each three hundred (300) square feet of gross floor area."

SECTION 26. THAT Section 29-26(c)(4) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"(4) Banners, pennants, searchlights, twirling signs, sandwich or
'A' frame signs, sidewalk or curb signs, balloons or other gas-
filled objects. (Except banners, pennants, searchlights, balloons
and other gas-filled objects may be permitted for a period not to
exceed sixteen (16) days for grand openings. Banners flat against
a wall or truck may be permitted for sidewalk sales. Permits for
grand openings and sidewalk sales shall be obtained from the Codes
Administrator or the Zoning Board of Adjustment.)"
SECTION 27. THAT Section 29-26(9)(3) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"(3) Specific Use District. The sign requirements for each use
shall be those of the most restrictive district in which the use
is otherwise permitted, except those signs that have been specifi-
cally described and indicated on the site plan approved by the
Planning and Zoning Commission and the City Council."
SECTION 28. THAT Section 29-26(h)(3} of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"(3) Specific Use District. The sign requirements for each use
shall be those of the most restrictive district in which the use
is otherwise permitted, except those signs that have been specifi-
cally described and indicated on the site plan approved by the
Planning and Zoning Commission and the City Council."
SECTION 29. THAT Section 29-26(1)(1) of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"(1) Specific Use District. The sign requirements for each use
shall be those of the most restrictive district in which the use
is otherwise permitted, except those signs that have been specifi-
cally described and indicated on the site plan approved by the
Planning and Zoning Commission and the City Council."
SECTION 30. THAT the first paragraph of Section 29-28(f)(2)j of the Code
of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows:
11 j. Outside Sales Activities. Permit in the C-2A, C-2, C-3, IHC,
IHI, C-4, M-1 and M-2 zoning districts, 'tents', 'tent sales',
'truckload sales', 'sidewalk sales', and 'sales of merchandise
outside any structure', subject to the following conditions:"

SECTION 31. THAT Section 29-28(f)(2)n of the Code of Ordinances, City of
Lubbock, Texas, is hereby amended to read as follows:
"n. Permit in any CA, C-2A, C-2, C-3 or IHO zoning district, as
provided for and established in this Code, a dance floor for
public dancing to be located within a restaurant, not to exceed
four hundred (400) square feet.11
SECTION 32. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed One Thousand and
No/100 Dollars ($1,000.00) as provided in Section 29-Jl{a) of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 33. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 34. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method
provided by law.
