AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW IN
CHANGE: ZONE CASE NO. 1466-A: CHANGE LOTS 1 THROUGH 21J WEST
WIND ADDITION, FROM AN "R-211 TO AN 11R-1" ZONING DISTRICT; AND A
TRACT OF LAND OUT OF SECTION 1, BLOCK J-S., CITY OF LUBBOCK, LUB-
BOCK COUNTY, TEXAS,. FROM AN "A-111 AND A 11C-3" TO A "C-311 ZONING
DISTRICT; SUBJECT TO CONDI'IDN; PROVIDING A PENALTY; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Council and, after due consideration,
the City Council finds that making the proposed change as hereinafter set out will
be in the public interest; and,
WHEREAS .. all conditions precedent required by law \or a valid amendme
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695., as well as notices
provide~ by Article lOllf, Vernon's Annotated Civil Statutes, amended in 1961,
and notice was duly published in the Lubbock Morning Avalanche Journal more
than fifteen (15) days prior to the date of the public hearing before the City Counc·
on such proposed amendment,. and the public hearing aecording to said notice was
duly held in the City Council Room on the second floor of the City Hall, Lubbock,
Texas, at which tirrepersons appeared in support of the proposal; and, after said
hearing, it was by the City Council determined that it would be in the public inter t
due to changed conditions, that the Zoning Ordinance and the Zoning Map be amen
in the manner hereinafter set forth in the body of this Ordinance and this Ordinan
having been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows~ to-wit: ·
ZONE CASE NO. 1466-A
Change· Lots 1 through 21, West Wind Addition,
from an 11R-2" to an "R-1" ·Zoning District, and
a tract of land out of Section 1, Block J-S, City
of Lubbock, Lubbock County, Texas.t from ari
11A-1" and a "C-3" to a "C ... 311 Zoning District.
Tract of land is further described by metes and
bounds to ... wit:
BEGINNING at a point which bears 1648. 15 feet East
and 50. 00 feet North of the Southwest corner of Sec-
tion 1, Block J-5, Lubbock County, Texas;
THENCE North a distance of 10. 00 feet;
THENCE Northwesterly around a curve to the right,
siad curve having a radius of 15. 00 feet, a tangent
length of 15. 00 feet, a delta angle of 90 degrees, a
chord distance of 21. 21 feet;
TH ENCE Northwesterly around a curve to the left,
said curve having a radius of 353. 51 feet, a tangent
length of 146. 43 feet, a delta angle of 45 degrees, a
.chord distance of 270. 56 feet;
THENCE North 45 degrees 00 minutes 00 seconds
West a distance of 205. 7 6 feet;
THENCE Northwesterly around a curve to the right,
said curve having a radius of 293. 51 feet, a tangent
length of 121.57 feet, a delta angle of 45 degrees, a
chord distance of 224. 64 feet;
THENCE East a distance of 1315.48 feet;
THENCE South a distance of 628.00 feet to the North
line of 4th Street;
THENCE West along the North line of 4th Street a
distance of 965.48 feet to the PLACE OF BEGINNING.

SUBJECT TO THE FOLLOWING CONDITIONS ON THE "C-311 TRACT OF LAND
ONLY.
1. That a minimum of 125t building setback be observed from the North
and South property lines except for a service station which may be constructed in
the Southwest corner of the "C ... 3 11 portion. In this event the service station shall
be set back a minimum of 431 from any street property line. (This setback in-
cludes pumps, pump islands and canopies).
2. That three (3) square feet of paved off-street parking area be provided
for each square foot of total building floor area.
SECTION 2. THAT from and after passage and effective date of this Or-
dinance said lots, tracts and parcels of land described in Section 1 hereof shall
be changed to the Zoning District indicated and the Official Map is amended in
ac co rdan ce herewith.
SECTION 3. THAT any person, firm or corporation owning or operation
the subject property failing to comply with the conditions imposed by Section 1 he
of shall be guilty of a misdemeanor and upon conviction :the"'Feo{~ shall be subject t
a fine not to exceed TWO HUNDRED DOLLARS and each and every day1s violation
thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property1o
comply with any of the conditions imposed by Section 1 hereof shall render the
President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this section.
SECTION 4. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason~ the
remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method pro-
vided by law.
AND IT IS SO ORDERED.
