ORDINANCE NO. 6131
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND
THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE
FOLLOWING CHANGE: ZONE CASE NO. 1744: CHANGE THE FOLLOWING
DESCRIBED TRACTS OF LAND OUT OF SECTION 101 BLOCK E-2, CITY
OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM AN "R-111 TO AN "R-211
"A-211 AND "C-211 ZONING DISTRICTS; SUBJECT TO CONDITION; PROVID-
ING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed change in zoning districts as hereinafter
made has been duly presented to the Zoning and Planning Commission for its
recommendation, which was received by the City Council and, after due con-
sideration, the City Council finds that making the proposed change as herein-
after set out will be in the public interest; and,
WHEREAS. all conditions precedent required by law for a valid amenc -
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695, as we
as notices provided by Article 1011f, Vernon's Annotated Civil Statutes,
amended in 1961, and notice was duly published in the Lubbock Morning Ava-
lanche Journal, more than fifteen (15) days prior to the date of the public hear
ing before the City Council on such proposed amendment, and the public hear
ing according to said notice was duly held in the City Council1 Room on the
second floor of the City Hall, Lubbocka Texas, at which time persons appear
ed in support of the proposal; and, after said hearing, it was by the City
Council determined that it would be in the public interest, due to changed
conditions, that the Zoning Ordinance and the Zoning Map be amended in the
manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map
BE and the same are hereby amended as follows. to-wit:
ZONE CASE NO. 1744
Change the following described tracts of land out
of Section 10, Block E-2, City of Lubbock, Lub-
bock County, Texas, from an "R-111 to an "R-2'\
"A-211 and 11C-2" Zoning Districts. Said property
is further described as follows:

TRACT a Change "R-1" to "A-2"
BEGINNING 420 feet south and 30 feet West of
the Northeast corner of the SE 1 / 4 of Section
10, Block E-2;
THENCE West 400 feet;
THENCE North 45 degrees West approximately
600 feet to a point in the North line of the SE l / 4
of Section 10, Block E-2;
THENCE East along the 1 / 2 sec. line approxi-
mately 650 feet to a point in the West ROW
line of Quaker Avenue;
THENCE South 27 degrees 031 East along the
West ROW line of Quaker Avenue, a distance
of approximately 250 feet to a point of curvature;
THENCE Southeasterly along the West line of
Quaker Avenue approximately 210 feet to the
PLACE OF BEGINNING.
TRACT LC Ch~e "R-1" to "C-211
BEGINNING 40 feet North and 30 feet West of
the Southeast corner of Section 10, Block E-2;
THENCE North 372. 3 feet;
THENCE West 501 feet;
THENCE South 372. 3 feet;
THENCE East 501 feet to the place of BEGINNING.
TRACT p> Change "R-1" to "R-2"
BEGINNING 420 feet South and 30 feet West of
the Northeast CO[;ner of SE 1 / 4 of Section 10,
Block E-2;
THENCE West 400 feet;
THENCE North 45 degrees West 600 feet;
THENCE West 215 feet;
THENCE South 45 degrees East 812 feet;
THENCE East 450 feet;
THENCE North 150 feet to the place of BE•
GINNING.
SUBJECT TO THE FOLLOWING CONDITION ON TRACT B ONLY:
If apartments are constructed, the density shall be one unit per 1500
square feet of net development lot area.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the Zoning District indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or oper-
ating the subject property failing to comply with the condition imposed by
Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof,
shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each
and every dayrs violation thereof shall constitute a separate and distinct
offense.
The failure of any corporation owning or operating the subject propert, r
to comply with any of the conditions imposed by Section 1 hereof shall render

the President, Vice-President, General Manager, Local Manager and Local
Aient liable to the penalty presecribed in this section.
SECTION 4. THAT shotild any paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative me-
thod provided by law.
