ORDINANCE NO. 6124
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND
THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE
FOLLOWING CHANGE: ZONE CASE NO. 1737: CHANGE A TRACT OF
LAND OUT OF SECTION 8, BLOCK E .. 2* CITY OF LUBBOCK, LUBBOCK
COUNTY* TEXAS, FROM AN "R-111 TO AN 11A-111 AND AN 11R-_211 ZONING
DISTRICTS; SUBJECT TO CONDITION: PROVIDING A PENALTY; PROVID ...
ING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS. the proposed change in zoning districts as hereinafter
made has been duly presented to the Zoning and Planning Commission for its
recommendation, which was received by the City Council and, after due con-
sideration, the City Council finds that making the proposed change as herein ...
after set out will be in the public interest; and,
WHEREAS,. all conditions precedent required by law for a valid amen -
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695, as
well as notices provided by Article lOllf, Vernon ts Anntoated Civil Statutes
amended in 1961, and notice was duly published in the Lubbock Morning Ava·
lanche Journal more than fifteen (15) days prior to the date of public hearing
before the City Council on such proposed amendment, and the public hearing
according to said nctice was duly held in the City Council Room on the second
floor of the City Hall., Lubbock, Texas, at which time persons appeared in
support of the pl'oposal; and, after said hearing., it was by the Ciy Council
determined that it would be in the public interest, due to changed conditions,
that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having
been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map
BE and the same are hereby amended as follows, to-wit:
Change a tract of land out of Section 8, Block E-2.,
City of Lubbock, Lubbock County., Texas., from an
11R-1" to an "A-111 and an "R-211 Zoning~· Districts.
Property is further described by metes and bounds
to-wit:
TRACT 1 118-1 11 Changed to an 11A-l" Zoning District
BEGINNING at a point which bears 1565 feet
West and 919 feet South of the N. E. Corner
of Section 8, Block E-2, Lubbock County, Texas;
THENCE South 22 6 feet,
THENCE West 180 feet,
THENCE North 226 feet,
THENCE East 180 feet to the POINT OF BE-
GINNING.
TRACT 2 118-111 Changed to an "R-2" Zoning District
BEGINNING at a point which bears 1565 feet
West and 1292 feet South of the N. E. Corner
of Section 8, Block E-2, Lubbock County, Texas;
THENCE West 180 feet,
THENCE North 127 feet,
THENCE East 180 feet,
THENCE South 127 feet to the POINT OF BE•
GINNING.
SUBJECT TO THE FOLLOWING CONDITION:
THAT development shall be in accordance with the site plan presented
and approved herewith, which is hereby adopted and made a part hereof for
all purposes. Said site plan is identified as: Final Site Plan, Zone Case 1737,
dated June 23, 1971.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the Zonging District indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or opera
ting the subject property failing to comply with the condition imposed by
Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof
shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each
and every day1s violation thereof shall constitute a separate and dist:inct
offense.
The failure of any corporation owning or operating the subject propert
to comploy with the condition imposed by Section 1 hereof shall render the
President., Vice-President, General Manager, Local Manager and Local
Agent liable to the penalty prescribed in this section.
SECTION 4. THAT should any paragraph., sentence., clause., phrase
or word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative me-
thod provided by law.
AND IT IS SO ORDERED.
