AN ORDINANCE Al\4ENDING THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK BY AMENDING ARTICLE VII, ENTITLED "AUDITORIUM-COLISEUM"
OF CHAPTER 2 THEREOF PROVIDING FOR SUPERVISION AND OPERATION;
PROVIDING FOR AN OPERATING FUND; PROVIDING FOR EX-OFFICIO BOARD
MEMBERS; PROVIDING FOR A DEPARTMENT HEAD; PROVIDING FOR A BON[
PROVIDING A SAVINGS CLAUSE AND PROVIDQiG FOR PUBLICATION.
WHEREAS, the City Counc• hal 'determined that the amendments to the City
Code governing operation of the Auditorium ... Coliseum, as set forth below, would
be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 2-54 of Article VII., Chapter 2. of the Code of
Ordinances of the City of Lubbock, BE and is hereby amended to read as follows:
Sec. 2-54. Supervision and Operation .. The Lubbock Municipal Auditor ...
ium ... Coliseum shall be supervised and controlled by an auditorium-coliseun
board to the extent as set out in this Article and in accordance with any
operating agreement in effect between the City and Texas Tech University.
SECTION 2. THAT Section 2-56 of Article VII. Chapter 2. of the Code of
Ordinances of the City of Lubbock. BE and is hereby amended to read as follows:
Sec. 2-56. Operating Fund .. A special fund designated "Auditorium ..
Coliseum Operating Fund II is hereby created and established. All money,
checks. drafts and other instruments representing or designed to represent
or accomplish payment for any and every operation, attraction. activity an
concession pertaining to the use of the auditorium ... coliseum or premises
shall be collected., deposited and paid into such fund, under the supervision
of the City finance officer, who shall provide adequate accounting and book-
keeping supplies. forms and procedures. Such fund shall not be used for
any purpose other than the business of operating the auditorium-colisc'lim
and premises and for such maintenance. repairs. additions and equipment
as may be authorized by the budget of the auditorium-coliseum operational
department duly approved. or supplemented by the City Council. as provide
by law.
SECTION 3. THAT Section 2-60 of Article VIl. Chapter 2. of the Code of
Ordinances of the City of Lubbock, BE and is hereby amended to read as follows:
Sec. 2 ... so. Ex officio Members -The City Council shall, by resolution,
designate officers of the City who shall be ex officio members of the audi-
torium .. colis eum board. without voting privileges, and who shall act in an
advisory capacity; provided however. that Auditorium .. Coliseum Manager
shall be an ex officio member.
/ SECTION 4. THAT Section 2-67 of Article VII, Chapter 2, of the Code of
Ordinances of the City of Lu~~-?cki ~~~ and is hereby amended to read as follows:

Sec. 2-67. Department,.Head -The head of the Auditorium--Coliseum
Department shall be a manager appointed by the City Manager and shall be
directly responsible to the City Manager or his designated staff director.
The Auditorium-Coliseum Manager shall work with the Auditorium-
Coliseu~ operational board in carrying out the duties prescribed in this
Article.
SECTION 5. THAT Section 2•68 of Article VII, Chapter 2, of the Code of
dinances of the City of Lubbock, BE and is hereby amended to read as follows:
Sec. 2-68. · Same • Bond. -The head of the auditorium-coliseum opera-
tional department shall make bond in some regularly accredited surety com-
pany authorized to do business in the state in the sum of twenty-five thousan,
dollars, such bond to be conditioned for the faithful discharge and performar.
of the duties of his office, and for the faithful accounting of all moneys,
credits and things of value to be collected or coming into the hands of such
officer. The premiµm for such bond shall be paid by the City and charged
to receipts of the auditorium .. coliseum. Such bond shall be required before
entering upon the duties of such office and no compensation shall be paid to
such officer for any date preceding the date of approval of the bond by the
City Att orney.
SECTION 6. Should any section., paragraph, sentence., clause, phrase. or
ord of this Ordinance be declared unconstitutional or invalid for any reason, the
emainder of this Ordinance shall not be affected thereby.
