ORDINANCE NO. __ 6 __ 1 .... 1....,3 __ AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF ORDI- NANCES OF THE CITY OF LUBBOCK, ENTITLED "MOTOR VEHICLES ANI TRAFF!C11 BY ADDING A NEW SECTION 18:-55. 1. PROHIBITING THE HA UL.- ING OF TRASH, GARBAGE, TREE LIMBS, GRASS CUTTING, DEBRIS, OR ANY OTHER WASTE OR DISCARDED MATERIALS UPON THE FOLLOWING PUBLIC STREETS OR PARTS THEREOF, WITHIN THE CORPORATE LIM- ITS OF THE CITY OF LUBBOCK, TO-WIT: MESA ROAD FROM AVENUE A (U. S. HIGHWAY 87) NORTH TO KENT AVENUE AND ON KENT AVENUE FROM NORTH MESA ROAD TO NORTH AVENUE Q, AND ON YUCCA ROAD FROM AVENUE A (U.S. HIGHWAY 87) TO MESA ROAD AND ON SUNSET LANE FROM AVENUE A (U.S. HIGHWAY 87) TO NORTH MESA ROAD; PROVIDING EXCEPTIONS FOR CITY OF LUBBOCK SANITATION DEPART ... MENT VEHICLES AND PRIVATE VEHICLES MAKiNG·c.oLLECTIONS''OF TRASH, GARBAGE AND ETC., FROM PROPERTIES ADJACENT TO THE DESIGNATED STREETS HEREIN; AUTHORIZING THE PLACING OF APPRO PRIATE SIGNS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS AND HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICT: ; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock has determined that it would best serve the health, safety, and general welfare of the citizen: of Lubbock to prohibit the hauling of trash, garbage and otherwaste material: upon residential streets, herein designated~ within the corporate limits of the City of Lubbock, NOW THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 18 of the Code of Ordinances, City of Lubbock., Texas, entitled "Motor Vehicles and Traffic II BE and is hereby amended by adding thereto a new Section 18-55. 1. which shall read as followi: 18-55. l. Prohibiting the hauling of trash, garbage, tree limbs and other waste materials from certain residential streets. It shall be unlawful for any person to drive or caus.e to be driven any vehicle or vehicles with a trailer hauling or carrying trash~ garbage, tree limbs.-grass cutting, debris, or any waste or discarded materials upon any of the following public streets or parts thereof, within the corporate limits of the City of Lubbock: Mesa Road from Avenue A (U. S. Highway 87) North to Kent A venue and on Kent A venue from North Mesa Road to North Avenue Q., and on Yucca Road from Avenue A (U. S. Highway 87) to Mesa Road and on Sunset Lane from Avenue A (U. S. Highway 87) to North Mesa Road. There is excepted from this section, however, official City of Lub- bock Sanitation Department vehicles and private vehicles or private vehicles with trailers whose purpose is the collection of trash, garbage, tree limbs, grass cutting., debris, and any other waste or discarded materials from properties adjacent to the designated streets herein. SECTION 2. THAT the City Manager is authorized and directed to cause the placing of appropriate signs upon all the streets or highways af- fected by this Ordinance and give notice when such prohibition shall be in effect. r-,,.:_: SECTION 3. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such con- flict exists. SECTION 4. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions here- of., and this Ordinance shall be cumulative of all other Ordinances except those with which it specifically conflicts. SEC_TION 5. •THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason~ the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT any person, firm, c or corporation violating the provisions of this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED DOLLARS ($200. 00). SECTION 7. THAT the City Secretary is authorized and directed to cause publication of the descriptive caption of this Ordinance together with the penalty as an alternative method of publication as provided by law.
