HomeMy WebLinkAboutOrdinance - 6111-1971 - Amending Ordinance 4251, Flashing School Zone, Speed Limit - 06/23/1971ORDINANCE NO. -~61=-l~l..__ __ _ AN ORDINANCE AMENDING ORDINANCE NO. 4251 OF THE CITY OF LUBBOCK; ESTABLISHING FLASHING SCHOOL ZONES AND AUTHORI- ZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMITS AT 20 MPH DURING SCHOOL HOURS IN SUCH ZONES AS PROVI- DED HEREIN; AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS;: RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS AND HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHAL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDI- NANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CON FLICTS; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, upon the basis' of an engineering and traffic investigation, finds that it is necessary to alter the prima facie speed limits established by Article 6701d, Sec. 166 (a)(l), Verne 's Texas Civil Statutes, as amended by the Texas Legislature, within the areas and locations named and described in the body of this Ordinance, andwithin the corporate limits of the City of Lubbock, and in the immediate vicinity of school areas during periods of time when schools are in session and schoo children are going to and from school and playgrounds; and, WHEREAS, the City Council of the City of Lubbock has determined the need to regulate moving vehicular traffic within the areas herein describe regarding passing and stopping for the protection and safety of pedestrians crossing the streets within such areas; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the prima facie speed limit established by Art. 6701d, Sec. 166(a)(l), Vernon's Texas Civil Statutes, is altered and changed for all vehicular traffic to twenty (20) miles per hour during school hours when the flashing traffic control signal is in operation on the following de - scribed streets and highways within the corporate limits of the City of Lubboc , Lubbock County. Texas, to-wit: A 20 MPH Flashing School Zone for the Northbound and Southbound traffic on Quitt Avenue beginning 205 ft. North of the center line of E. 14th Street and extending South for 420 ft. to a point 215 ft. South of the center line of East 14th Street. A 20 MPH Flashing School Zone for the Southbound traffic on Avenue T (A one way street) beginning 25 ft. North of the North curb line of 13th Street on the West side of Avenue T, and extending South for a distance of 579 ft. to a point 40 feet South of the South curb line of 14th Street; A 20 MPH Flashing School Zone for the Eastbound and Westbound traffic for West 34th Street beginning at 231 feet West of the center line of Chicago Avenue and extend- ing East for 441 feet to a point 210 feet East of the center line of Chicago Avenue. A 20 MPH Flashing School Zone for the Northbound and Southbound traffic of Quaker Avenue beginning 200 feet South of the North curb line of 60th Street and extending Nor1h for 1, 019 feet to a point 200 feet North of the South curb line of 58th Street. SECTION 2. THAT the City Manager is authorized and directed to cause the placing of signs and traffic control signals so as to clearly define the limits of the prima facie areas set out in this Ordinance, and give notice when such speed limit shall be in effect. SECTION 3. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such con- flict exists. SECTION 4. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 5. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall, upon conviction, ., be fined any sum not to exceed TWO HUNDRED ($200, 00) DOLLARS. SECTION 7. THAT the City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law.
