ORDINANCE NO. 9665 -----
AN ORDINANCE AMENDING ZONING ORDIN NCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK MAKING THE FOLLO G CHANGES: ZONE CASE NO. 2161-C; A
ZONING CHANGE FROM C-2, GO AND R-1 TO C-ZONING ON A 7 ACRE TRACT OF LAND OUT
OF SECTION 13, BLOCK E-2, LUBBOCK, S; PROVIDING A PENALTYi PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Convn1ss1on for its recommendation
which was received by the City Council and, after due consideration, the City
Council found that due to changed conditions, it would be expedient and in the
interest of the public health, safety and general welfare to make those pro-
posed changes in zoning; and
WHEREAS, the 1986 Comprehensive Land Use Plan is a guide to help the
Lubbock Planning and Zoning Commission and City Council determine the physical
development of the community; however, planning 1s a continuous process and
change is inevitable; and
WHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, including giv-
ing notices in compliance with Section 29-29 of the Code of Ordinances, City
of Lubbock, Texas, and the notices provided by the Texas Local Government Code
§211.007 (Vernon, 1990), and notice was duly published in the Lubbock Aya]anche-Journa] more than fifteen (15) days prior to the date of the public
hearing before the City Council on such proposed amendment, and the public
hearing according. to said notice, was held in the City Council Chamber of the
Municipal Building, Lubbock, Texas, at which time persons appeared in support
of the proposal; and after said hearing, it was by the City Council determined
that it would be in the public interest, due to changed conditions, that the
Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set
forth in the body of this Ordinance and this Ordinance having been introduced
prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2161-C
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are
amended as follows:
A change of zoning under the provisions of Section 29-29 of the
Code of Ordinances of the City of Lubbock from C-2, GO and R-1 to
C-3 zoning district. on a 7 acre tract of land out of Section 13,
Block E-2, City of Lubbock, Lubbock County, Texas, located at the
Southwest corner of 82nd Street and Boston Avenue, and being fur-
ther described as follows:
METES AND BOUNDS DESCRIPTION of a 7 acre tract of land located in
Section 13, Block E-2, Lubbock, Lubbock County, Texas, being fur-
ther described as follows:
BEGINNING at a point which bears S. 89°58'08 11 W. a distance of
1263.07 feet and S. 00°01'52 11 E. a distance of 58.50 feet from the
Northeast corner of Section 13, Block E-2, Lubbock, Lubbock
County, Texas;
THENCE N. 89°42'23 11 E. a distance of 50.00 feet to a point of cur-
vature;
THENCE Southeasterly around a curve to the right, said curve hav-
ing a radius of 15.00 feet, a central angle of 90°15'45 11 , tangent
lengths of 15.07 feet and a chord distance of 21.26 feet;
THENCE S. 00°0l'52 11 E. a distance of 566.73 feet to a point of
curvature;
THENCE Southwesterly around a curve to the right, said curve hav-
ing a radius of 15.00 feet, a central angle of 90°, tangent
lengths of 15.00 feet and a chord distance of 21.21 feet;
THENCE s. 89°58'0811 w. a distance of 497.04 feet;
THENCE N. 00·01•52• W. a distance of 595.00 feet;
THENCE N. 89°58'0811 E. a distance of 120.17 feet;
THENCE N. 89°42'2311 E. a distance of 376.80 feet to the POINT OF
BEGINNING.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and
No/100 Dollars ($2,000.00) as provided in Section 29-3l(a) of the Zoning Ordi-
nance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method
provided by law.

PUBLIC HEARING
NOTICE is hereby given that the City Council will hold a Public
Hearing on Thursday, October 28, 1993 at 10:30 a.m., in the City
Council Chambers, 1625 13th Street, Lubbock, Texas, to consider
the recommendations by the Planning and Zoning Commission that
zoning be changed on certain properties in Lubbock, Texas. City
of Lubbock City Council meetings are available to all persons
regardless of disability. If you require special assistance,
please contact the city Secretary's Office at 767-2025 or
Community and Neighborhood Services (for the hearing impaired) at
747-2888 (Monday-Friday, 8:00-5:00 p.m.) or 1625 13th Street Room
206 at least 48 hours in advance of the meeting. All interested
persons may speak, then the City Council will act on such
recommendations. The following zone cases will be heard:
ZONE CASE NO. 2460-J: Request of Henry L. Huneke (for Escondido
