AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE
PERMIT., TO-WIT: ZONE CASE NO. 1726: CHANGE LOTS 8, THROUGH 10
NANCY ADDITION, CITY OF LUBBOCK_. LUBBOCK COUNTY, TEXAS FRO

WHEREAS, after receiving the recommendations of the Planning and
Zoning Commission and after due notice and public hearing and all matters
having been done and performed as required by Section 14-A of Zoning Or-
dinance No. 1695 of the City of Lubbock, (said Ordinance being an Appendix
to the Lubbock City Code) relating to Specific Use Permits, the City Council
finds that due to changed conditions, it would be expedient and in the interest
of the public health, morals, and general welfare to authorize the granting of
a Specific Use Permit as hereinafter set forth; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Director of Planning of the City of Lubbock is
authorized to issue a Specific Use Permit to the Applicant in Zone Case No.
1726 in accordance with the recommendations and conditions imposed by the
Planning and Zoning Commission, on file with the office of the Director of
Planning, and the City Council which are hereby adopted and incorporated
herein by reference for all purposes, provided said Applicant agrees to be
bound by the terms of the Specific Use Permit, the granting of which is hereā¢
by made subject to compliance to all provisions of Zoning Ordinance No. 1695
an Ordinance of the City of Lubbock, including particularly but not limited to,
Section 14-A of Zoning Ordinance No. 1695 within twenty-four (24) months of
the effective date of this Ordinance, the City Secretary-Treasurer shall be
and is hereby authorized and instructed, upon written notice from the Direc-
tor of Planning that Applicant has not complied with the provisions, condition
and terms imposed by this Ordinance, to note Applicant1s failure to comply o
the margin of the Minutes of the City Council opposite entry of this Ordinance,
and the authorization to issue such Specific Use Permit is hereby revoked;
and the Director of Planning in such event is directed to remove from the
Zoning Map the legend indicating such limited use. The Specific Use authoriz
ed by this Ordinance is for Professional Type Offices, under provisions of
Section 14-A.1-10. of the Zoning Ordinance on the property below described.

ZONE CASE NO. 1726
Change from an "A-211 Zoning District to an
"A-211 Specific Use Permit the following de-
scribed property:
Lots 8 through 10, Nancy Addition to the Cfy
of Lubbock, Lubbock County, Texas.
SUBJECT TO THE FOLLOWING CONDITION:
1. That one (1) paved off-street parking space be provided for every
two-hundred (200) square feet of total building area.
SECTION 2. THAT any person, firm, or corporation owning or oper
a ting the subject property fail:ing to comply with the condition imposed by
Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof
shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each
and every day1s violation thereof shall constitute a separate and distinct offen e.
The failure of any corporation owning or operating the subject propert
to comply with any of the conditions imposed by Section 1 hereof shall render
the President, Vice-President, General Manager, Local Manager and Local
Agent liable to the penalty prescribed in this section.
SECTION 3. THAT should any section, paragraph, sentence, clause,
phrase, or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided bylaw.
