ORDINANCE NO. 9645
AN ORDINANCE ABANDONING AND 'cLOSING A FIVE FOOT UTILITY EASEMENT LOCATED
IN LOTS 1-A-l AND 2-A-l, FIESTA'. AUTOLAND CENTER ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF
THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the utility easement hereinafter
described in the body of this Ordinance is no longer needed for public use and
it would be in the public interest to close, vacate and abandon the same; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION l. THAT the utility easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, and being more particularly described as follows:
METES AND BOUNDS DESCRIPTION of a 5 foot easement granted to
Lubbock Power and Light Company in Volume 1177, Page 41 of
the Deed Records of Lubbock County, Texas, located in Lots
1-A-l and 2-A-l, Fiesta Autoland Center Addition to the City
of Lubbock, Lubbock County, Texas;
BEGINNING at a point which bears South a distance of 207.65
feet from the original Northeast corner of Lot 2-A-l, Fiesta
Autoland Center Addition to the City of Lubbock, Lubbock
County, Texas;
THENCE South a distance of 5.12 feet;
THENCE N. 77°44' W. a distance of 310.66 feet;
THENCE N. 89°56' W. a distance of 189.06 feet;
THENCE S. 59°54' W. a distance of 124.78 feet;
THENCE North a distance of 5.78 feet;
THENCE N. 59°54' E. a distance of 123.22 feet;
THENCE s. 89°56' E. a distance of 190.94 feet;
THENCE S. 77•44, E. a distance of 309.51 to the POINT OF
BEGINNING.

SECTION 2. THAT the City Engineer is hereby authorized and directed to
mark the official maps of the City of Lubbock to reflect said abandonment and
closing, showing the number of this Ordinance and the date of its final pas-
sage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause
or word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of
this Ordinance as an alternative method provided by law.
