HomeMy WebLinkAboutOrdinance - 9640-1993 - Amending Chapter 2 & 6 Appeals From Board Of Electrical Examiners. - 08/26/1993First Reading August 26, 1993 Item #39 Second Reading September 9, 1993 Item #14 ORDINANCE NO. 9640 AN ORDINANCE AMENDING CHAPTER 2 AND CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO APPEALS FROM THE BOARD OF ELECTRICAL EXAMINERS; ADOPTING THE 1993 NATIONAL ELECTRICAL CODE; ADDING A NEW SECTION 6-151.l PERTAINING TO ELECTRICAL WORK INSTALLED BY UNLICENSED PERSONS; AMENDING THE REQUIREMENTS FOR A JOURNEYMAN ELECTRICIAN'S LICENSE; AMENDING SECTION 6-163(b) TO PROVIDE A SURETY BOND ALTERNATIVE TO INSURANCE FOR MASTER ELECTRICIANS; AMENDING A PORTION OF THE NATIONAL ELECTRICAL CODE WITH REGARD TO PENINSULA RECEPTACLES; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Board of Electrical Examiners of the City of Lubbock has recommended certain changes to the Electrical Code of the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock believes that such changes would be in the best interest of the health, safety and welfare of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT section 2-458 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Sec. 2-458. Decisions to be final and binding. The decision of the board of electrical examiners pursuant to the authority granted to it by Article XVII of Chapter 2 of the Code of Ordinances shall be final and binding as to the matter heard in such appeal. SECTION 2. THAT section 6-141 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Sec. 6-141. National Electrical Code adopted by reference. The book entitled "National Electrical Code," 1993 Edition, {NFPA 70), a copy of which, authenticated by the signature of the building official, shall be filed with the city secretary as a public record, is hereby adopted as a part of this Code as if fully copied herein in detail. In the event of a conflict between a provision of the "National Electrical Code" and the Code of Ordinances, this Code of Ordinances shall prevail. References in the Code of Ordinances to the "National Electrical Code" shall mean the 1993 Edition of said book. SECTION 3. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a section, to be numbered section 6-151.1, which said section reads as follows: Sec. 6-151.1. Removal of work performed by unlicensed persons; exceptions. (a) Any electrical work installed by unlicensed persons shall be completely removed from any structure prior to a permit being issued to an electrician licensed to do work in the Ctty of Lubbock. (1) A demolition electrical permit shall be issued to a licensed electrician to remove all work performed by any unlicensed person. on any structure. (2) The fee for a demolition permit on unlicensed work shall be the same as for the electrical permit required for the work and the electri- cal permit required for the work, whether complete or incomplete, shall be double the normal fee because the work was started by an unlicensed person prior to acquiring a permit. (b) Exceptions: (1) Existing electrical work installed by unlicensed persons may be used provided it is approved by the building official; and (2) A licensed master electrician will certify the work in writing and accept full responsibility for the work; or SECTION 4. THAT subsection 6-159(a){2) of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: (2) He shall have four (4) years experience as a full-time apprentice in electrical construction under a licensed master electrician performing electrical construction work for the general public; or SECTIONS. THAT the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a section, to be numbered section 6-244.1, which said section reads as follows: Sec. 6-244.1. Kitchen peninsula and island counter top receptacles. Section 210-52(c) of the National Electrical Code is hereby amended by amending the third sentence of the paragraph to read as follows: - 2 - A receptacle outlet shall be installed at each island counter top with a long dimension of 24 inches (610 mm} or greater and a short dimension of 12 inches (305 mm) or greater. Receptacle outlets to serve island counter tops shall be installed above. or within 12 inches (305 mm) below the counter top. Receptacle outlets shall be installed so that no point along the centerline of the long dimension is more than 24 inches (610 mm}, measured horizontally from a receptacle outlet in that space. For peninsular counter tops without a vertical backsplash, a receptacle shall be installed at the wall directly above where the peninsular counter top attaches. Peninsular counter tops with a vertical backsplash of s• or greater shall have at least one receptacle for each four (4) feet of length. SECTION 6. THAT any person. firm or corporation violating any provision of this Ordinance shall, upon conviction. be fined any sum not exceeding two hundred dollars ($200.00). SECTION 7. THAT should any section, paragraph, sentence, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. - 3 - AND IT IS SO ORDERED.
