HomeMy WebLinkAboutOrdinance - 9631-1993 - Closing 20 Ft Underground Utility Easement All Saints Addition - 08/08/1993II i First Reading July 8, 1993 Item #26 Second Reading March 24, 1994 Item #12 ORDINANCE NO. 9631 ----- AN ORDINANCE ABANDONING AND CLOSING A 20-FOOT UNDERGROUND UTILITY EASEMENT LOCATED IN ALL SAINTS ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the underground utility easement as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the underground utility easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described as follows: A portion of a 20 foot underground utility easement located in Tract 4-A-1-A, a replat of Tract 4-A-l, a replat of Tract 4-A, a replat of Tract 4, All Saints Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears S. OOD00'20" E. a distance of 1113.00 feet and N. 89°59'40" E. a distance of 949.00 feet from the Northwest corner of Section 19, Block E-2, Lubbock, Lubbock County, Texas; THENCE S. 00°00'20" E. a distance of 104.98 feet; THENCE N. 81°31'51" E. a distance of 20.22 feet; THENCE N. 00 8 00'20" W. a distance of 102. 00 feet; THENCE N. 89°59'40" E. a distance of 20.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock 1s hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
