HomeMy WebLinkAboutOrdinance - 9608-1993 - Zone Case 1893-R Zoning Change C-2A To A-1 Shadow Hills Addition - 04/22/1993First Reading, April 22, 1993 Item #20 Second Reading May 13, 1993 Item /115 ORDINANCE NO. 9608 ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1893-R; A ZONING CHANGE FROM C-2A TO A-1 ZONING ON A PORTION OF TRACT C, SHADOW HILLS ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVID- ING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those pro- posed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giv- ing notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1893-R SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from C-2A to A-1 zoning district, on a portion of Tract C, Shadow Hills Addition, City of Lubbock, Lubbock County, Texas, 1 ocated North of 3rd Street and West of Frankford Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a portion of Tract "C", Shadow Hills Addition to the City of Lubbock, Lubbock County, Texas, and a tract located in Section 2, Block J-S, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears North a distance of 734.41 feet and S. 89°58 1 12" W., a distance of 2580.81 feet from the South- east corner of Section 2, Block J-2, Lubbock, Lubbock County, Texas; THENCE North a distance of 71.64 feet; THENCE N. 81°15'20" E. a distance of 281.86 feet; THENCE N. 75°05 1 0011 E. a distance of 629.08 feet; THENCE N. 27°45 1 3011 E. a distance of 370.96 feet; THENCE S. 62°14'3011 E. a distance of 151.01 feet; THENCE N. 33°13'07" E. a distance of 84.89 feet; THENCE S. 30° E. a distance of 646.33 feet; THENCE S. 60° W. a distance of 155.00 feet to a point of curva-ture; THENCE Westerly around a curve to the right, said curve having a radius of 559.81 feet, a central angle of 30°, tangent lengths of 150.00 feet; and a chord distance of 289.78 feet; THENCE West, at a distance of 200.00 feet pass a found 1/2" iron rod, continuing for a total distance of 347.00 feet to a point of curvature; THENCE Westerly around a curve to the right, said curve having a radius of 610.17 feet, a central angle of 23°, tangent lengths of 124.14 feet; and a chord distance of 243.30 feet to a point of re- verse curvature; THENCE Westerly around a curve to the left, said curve having a radius of 737.27 feet, a central angle of 23°, tangent lengths of 150.00 feet; and a chord distance of 293.98 feet; THENCE West a distance of 275.00 feet to the POINT OF BEGINNING. ZONE CASE NO. 1893-R. --PAGE 2 -- SUBJECT TO THE FOLLOWING CONDITION: a. That a street right-of-way from 3rd Street to 4th Street be estab~ l ished, dedicated, and proposed for improvement prior to or in conjunction with a construction permit. If acquiring the right- of-way becomes impossible, an item shall be placed on the City Council Agenda as other business for review and resolution of the issue. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/1OO Dollars ($2,000.00) as provided in Section 29-31(a) of the Zoning Ordi- nance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. Passed by City Council 1993.
