First Reading March 11; 1993 Item #30 · Second· Reading March 25,. 1993 Item f/5 Vot 4161rAG[ 57 ORDINANCE N0._...:;.9~5=-=99;...._ __ AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A PUBLIC STREET LOCATED IN SECTION 42, BLOCK AK, LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portion hereinafter described in the body of this Ordinance is no longer needed for street purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for street purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portion as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use, and being more particularly described as follows: BEGINNING at a point which bears South 1169.00 feet and West 312.00 feet from the Northeast corner of Section 42, Block AK, · Lubbock County, Texas; THENCE West a distance of 43.00 feet; THENCE South a distance of 215.00 feet; THENCE East a distance of 28.00 feet; THENCE North a distance of 200.00 feet; THENCE Northeasterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°00'00", and a chord length of 21.21 feet, a curve distance of 23.56 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. -' . THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
