HomeMy WebLinkAboutOrdinance - 9586-1993 - Zone Case 1123-C Zoning Change From C-3 To C-4 Specific Use Bumper Boat Pool - 02/11/1993First Reading February 11, 1993 Item #18 Second Reading February 25, 1993 Item 116 ORDINANCE NO. 9586 ------ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1123-C; A ZONING CHANGE FROM C-3 AND C-4 SPECIFIC USE TO C-4 SPECIFIC USE TO AMEND SITE PLAN TO INCLUDE BUMPER BOAT POOL AND 60 KART TRACT ON LOT 306-A, MIDWAY PARK ADDITION AND A TRACT OUT OF SECTION 17, BLOCK B, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Conuniss1on for its reconunendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those pro- posed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giv-ing notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Aya]anche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on the proposed amendment, and the public hearing according to said notice, was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in sup- port of the proposal; and, after said hearing, it was determined by the City Council that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1123-C SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning from C-3 and C-4 Specific Use to C-4 Specific Use, under provisions of Section 29-24(c)(24) of the Code of Ordinances of the City of Lubbock for amending the site plan to include the addition of a ten (10) boat Bumper Boat Pool and an eighteen (18) Go-Kart Formula K Go- Kart tract, while continuing to allow batting cages, gameroom, and golf course, on Lot 306-A, Midway Part Addition and a tract out of Section 17, Block B, City of Lubbock, Lubbock County, Texas, located at 5110 29th Drive, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a tract located in Section 17, Block B, Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at the original Northwest corner of Lot 306-A in a Northwesterly direction along the curve of the East line of 29th Drive, a distance of 95.00 feet with the chord distance between said points being a bearing of North 22°24'21" W; THENCE N. 53°54' E. a distance of 649.50 feet; THENCE s. 00°06' 1511 E. a distance of 4. 75 feet; THENCE S. 10°57'15" E. a distance of 215.25 feet to the original Northeast corner of Lot 306-A; THENCE N. 76°38'46" W. a distance of 257.86 feet, along the original North boundary of Lot 306-A; THENCE S. 53°54' W. a distance of 313.42 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: a. That it be tied to site p 1 an 1123-C as presented to the Planning and Zoning Conunission and signed by the Chairman on December 3, 1992. b. That no alcoholic beverage permit shall be issued for this parcel. c. That Putt-Putt shall install a six (6) foot chain link fence on the Eastern boundary of its development. Any gates or openings sha 11 be kept 1 ocked to prevent unauthorized ingress or egress to the playa lake area. d. That Putt-Putt shall install and maintain a six (6) foot high screening fence with metal standards along the North property line. e. That should the Director of the Planning Department of the City of Lubbock verify a complaint in writing about noise generated from the Putt-Putt property from a resident of a townhouse or from the Board of ZONE CASE BO. 1123-C ---PAGE 2 --- Directors at Midway Park Homeowners' Association, Inc., the operator of Putt-Putt shall be notified to conduct noise measurements by a competent contractor at the South boundary of the townhouse project. If the process identifies noise generated at the Putt- Putt facility at any time of day or night in excess of 56 decibels c•a• weighted decibels (dba)), management at the Putt-Putt shall take whatever measures necessary to reduce the noice to a level at or below the 56 decibels. SECTION 2. THAT the granting of this specific use zoning is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification, which in this case is the C-3 and C-4 zone districts with conditions in Ordinance No. 8039; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(24) of Codified Zoning Ordi-nance No. 7084 on the property described as Lot 306-A, Midway Park Addition and a tract out of Section 17, Block B, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordi- nance of the City of Lubbock. SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. THAT the City Secretary is hereby authorized to cause publi-cation of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
