HomeMy WebLinkAboutOrdinance - 6048B-1983 - Amending Portions Of Chapter 11, Code Of Ordinances, Fire Lanes, Section 11-13 - 09/22/1983LJM:da ORDINANCE NO. 6048-B ------AN ORDINANCE AMENDING CERTAIN PORTIONS Of CHAPTER 11 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO FIRE LANES AND PROVIDING A SAVINGS CLAUSE. WHEREAS, the City Council is of the opinion and deems it to be in the best interest of the health, safety and welfare of the citizens of the City of Lubbock to make the following changes to Chapter 11 of the Code of Ordinances; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 11 of the Code of Ordinances, City of Lubbock, BE and is hereby amended by amending Section 11-13 to read as follows: Section 11-13 Same -Signs; obstructions generally. The owner, manager or person in charge of any building to which fire lanes or turnarounds have been designated by the fire marshal or his designated representative shall appropriately mark the fire lane in a conspicuous manner and such markings shall be maintained by such person so that they are at all times clearly visible to the general public. "Appropriate markings" as required in this section shall mean that: (1) the perimeter of the fire lane easement shall be outlined in broken red striping, which striping shall be a least six (6) inches wide and no more than ten (10) feet in length, with no more than ten (10) foot intervals between such stripes; and (2) the words, "NO PARKING-FIRE LANE" shall be painted at intervals of not more than forty (40) feet across the fire lane with red letters not less than one (1) foot in height on a contrasting background; and, in addition to the above, (3) if the fire lane has a curb as one edge of its perimeter, the curbing shall be painted solid red along the fire lane easement; and, at the owner's preference, the words, 11NO PARKING-FIRE LANE-TOW AWAY ZONE" shall either: (A) be painted, at intervals of not more than forty (40) feet, in white letters, not less than four (4) inches in height on the red curb, or in the alternative, (B) be posted by signs adjacent to the curb consisting of red letters painted on a white background. These shall be located at intervals of not more than forty (40) feet along the side of the fire lane easement. The red letters shall be not less than three (3) inches in
height as to "NO PARKING,11 not less than two (2) inches in height as to "FIRE LANE,11 and not less than one (1) inch in height as to "TOW AWAY ZONE. 11 The fire marshal or his duly authorized representative or the chief of police or his duly authorized representative is hereby authorized to cause such streets, fire lanes and turnarounds to be maintained free and unobstructed at all times for fire department uses. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed TWO HUNDRED DOLLARS ($200.00) as provided in Section 1-4 of the City Cade. SECTION 3. THAT should any section, paragraph, phrase, clause, sentence or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT 15 SO ORDERED. FIRE LANE ENFORCEMENT Present Section 11:13: Post and maintain appropriate signs in conspicuous places along such fire lanes or turnarounds stating "NO PARKING -FIRE LANE -TOW AWAY ZONE,11 This may be accomplished at the owner's preference by the use of a single sign or by the use of two signs mounted together on a single post, one designating "NO PARKING -FIRE LANE11 and one designating "TOW AWAY ZONE." Section 11-13: "Appropriate signs, as required in these sections, shall consist of red letters painted on a white background located at not more than twenty (20) feet intervals along one side of the fire lane easement. Those letters shall be not less than three (3) inches in height as to "NO PARKING11, not less than two inches in height as to "FIRE LANE11 and not less than one (1) inch in height as to 11TOW AWAY ZONE. 11 The curbing shall be painted solid red along the side of the fire lane easement and the perimeter of the fire 1ane easement shall be out-lined with broken red striping, which striping shall be at least six (6) inches wide and no more than ten (10) feet in length, with no more than ten (10) foot inter-vals between such stripes. Proposed Section 11:13: appropriately mark the fire lane in a conspicuous manner and such markings shall be maintained by such person so that they are at all times clearly visible to the general public. Section 11:13: "Appropriate mark-ings" as required in this section shall mean that: (1) the peri-meter of the fire lane easement shall be outlined in broken red striping, which striping shall be at least six (6) inches wide and no more than ten (10) feet in length, with no more than ten (10) foot intervals between such stripes; and (2} the words, "NO PARKING-FIRE LANE" shall be painted at intervals of not more than forth (40) feet across the fire lane with red letters not less than twelve (12) inches in height on a contrasting background; and in addition to the above. (3) if the fire lane has a curb as one edge of its perimeter, the curb-ing shall be painted solid red along the fire lane easement; and, at the owner's preference, the words, "NO PARKING-FIRE LANE-TOW AWAY ZONE" shall either: (A) be painted, at intervals not more than forty (40) feet, in white letters, not less than four (4) inches in height on the red curb, or in the
