HomeMy WebLinkAboutOrdinance - 6048-1971 - Amending Chapter 12, Code Of Ordinances, "Fire Proection", Section 12-10.1 - 03/11/1971KJ:sw ORDINANCE NO. 6048 AN ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK~ TEXAS, ENTITLED "FIRE PROTECTION," BY ADDING THERETO A NEW SECTION 12-10.1 PRO- VIDING FOR THE REQUIREMENT OF FIRE LANES AND PROHIBITING PARKING THEREON; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock has found that the following changes in the 11Fire Protection" Ordinance of the City of Lub- bock would be in the best interest and safety of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 12 of the Code of Ordinances of the City of Lubbock, BE and is hereby amended by adding thereto a new Section 12- 10. 1, which shall read as follows: "Section 12-10. 1. Requiring fire lanes for building and prohibiting parking thereon. A. No building of any type construction for any occupancy except buildings of Type I, II, III, and IV construction when equipped with an approved automatic sprinkler system and buildings housing one family and two family dwelling units situated on a single lot and Group J occupancies, as defined in the Building Code of the City of Lubbock, shall be construe ted unless every part of the structure can be reached from a public street or highway with 150 feet of fire hose; provided that said structure may be erected at a greater distance if th owner, manager or person in charge constructs and maintain a fire lane as designated by the Fire Marshal, having a min- imum width of 20 feet and a minimum height clearance of 14 feet, to a point from which every portion of the structure can be reached with 150 feet of fire hose; or, where dimensions of any structure are such that any portion of the structure is more than 150 feet from an exterior wall, then standpipes shall be installed in an approved manner within the building and approved fire lanes or streets shall be provided adjacent to the building. Standpipe installations shall be in accordance with the standards set forth in the building code of the City of Lubbock. .. ~ ~. ;. • j J ""',__.., B. Any such fire lane, more than 100 feet long. shall either connect at both ends to a dedicated street or be provided with a turn-around having a-mti.nimum radius of 50 feet. C. All fire lanes shall be maintained and kept in a state of good repair at all times by the owner, manager or person in charge of the premises, and the City of Lubbock shall never be responsible for the maintence thereof. D. The Fire Marshall or his designated representative is hereby authorized to designate adequate fire lanes and/or turn-arounds to any building when deemed necessary for fire department access in the event of fire in such building. Such fire lanes shall be designated only upon the agreement betwee1, the Fire Marshall and the property owner, manager or devel- oper, that such location of a fire lane is mutually acceptable. In the event an agreement cannot be reached as to the loca- tion of any fire lane, the matter shall be presented to the building Board of Appeals who shall make such designation. E. The owner, manager or person in charge of any building to which fire lanes, or turn-arounds have been designated by the Fire Marshall or his designated representative shall post and maintain appropriate signs in conspicious places along such fire lanes or turn-arounds stating 11FIRE LANE -NO PARKING,'' The Fire Marshall or his duly authorized repre- sentative or the Chief of Police or his authorized representa- tive is hereby authorized to cause such streets, fire lanes anc turn-arounds to be maintained free and unobstructed at all times for fire department uses. 'Appropriate signs r, as re- quired in this paragraph, shall consist of red letters not less than 4 inches in height, painted on a white background loca- ted not more than 15 feet horizontally along the perimeter of the fire lane easement, or, as an alternative, the perimeter of the fire lane may be outlined with broken red striping, and the signs then may be painted at intervals across the fire lane with red letters not less than 6 inches in height on a contras- ting background. F. Parking in Fire Lanes Prohibited. 1. No person shall park or place nor allow!· permit or suffer to be parked or placed or to remain unattended any mdor ve- hicle, trailer, boat, machinery or similar obstruction within or upon an area designated or dedicated as a fire lane and marked by an appropria.1:e sign placed in a conspicious place. u p 2. If a motor vehicle~, trailer, boat, machinery or similar obstruction is found parked or unoccupied within an area designated or dedicated as a fire lane as required by this section, the same is hereby declared a nuisance per se, and the fact that such motor vehicle, trailer, boat, machinery or similar obstruction is parked or is unattended or unoc- cupied in such a manner as to obstruct in whole or in part any such fire lane shall be prima facie evidence that the registered owner unlawfully parked, placed or permitted to be parked or placed such obstruction within a fire lane. 3. The records of the State Highway Department or the County Highway License Department showing the name of the person to whom the Texas Highway License or boat or trailer license was issued shall constitute prima facie evidence of ownership by the named person, G. Issuance of Citations and Impoundment of Obstructions 1. If any motor vehicle, trailer, boat, machinery or simila h obstruction is found parked or unattended in or upon a prop- erly marked fire lane which has either been designated or , dedicated as a fire lane, the Fire Marshal or any member of the Fire Department designated by the Fire Marshal is hereby authorized to issue a citation for such violation, charging the owner, as defined in subsection F above, with the violation which shall constitute a misdemeanor the pen- alty for which shall be $5. 00 upon conviction, and may have such obstruction removed by towing it to such place as des- ignated by the Fire Marshal. Such vehicle or obstruction may be redeemed by payment of the Impounding Fee and storage charges in the same manner and at the same rate as any vehicle impounded for illegal parking as set forth in Sec- tion 18-102 of this Code, 2, No citation as provided for in Paragraph 1 above shall be voided by the redemption of the obstruction from the place of impoundment, nor shall the violator be relieved of any penalty assessed by a Judge of the Municipal Court for a violation of any provision of this section. H. Abandonment or Closure of Fire Lanes. No owner, manager or person in charge of any premises served by a required fire lane shall abandon or close any such fire lane without written permission of the Fire Marsh • SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affec- ted thereby. SECTION 3. THAT the City Secretary is hereby authorized to caus publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
