WHEREAS, the City Council finds that the overhead powerline easement and storm water storage and drainage ·easement as hereinafter descn'bed in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. TIIAT the overhead powerline easement and storm water storage and drainage easement as hereinafter descn"bed shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement bemg more particularly described as follows: IRACft An overhead powerline easement located in Section 14, Block E-2, Lubbock County, Texas, and being further described as follows: BEGINNING at a point which is a distance of 1,000 feet North of the Southwest comer of Section 14, Block E-2, Lubbock County, Texas; THENCE 5.00 feet either side of a line East, a distance of 145.00 feet. TRACf2 METES AND BOUNDS DESCRIPTION of a portion of a 70 foot storm water storage and drainage easement to be closed and abandoned, located in Section 14, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 00°03'13" E. a distance of843.37 feet and S. 89°58'50" E. a distance of70.00 feet from the Southwest comer of Section 14, Block E-2, Lubbock County, Texas; THENCE N. 19°55' 46" W. a distance of 58.52 feet; THENCE N. 00°03'13" E. a distance of 152.85 feet; THENCE N. 20°02'12" E. a distance of58.52 feet; THENCE S. 00°03' 13" W. a distance of 262.85 feet to the POINT OF BEGINNING. ·""'-· VOL4631PAC£ 82 SECTION 2. TIIAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number ·of this Ordinance and the date of its final passage. . SECTION 3. TIIAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordi- nance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
