GSL:sw ;, - A~end Ordinance No. 6038 BY Ordinance No. 6176 ORDINANCE NO. 6038 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 5308 OF e THE CITY OF LUBBOCK COVERING ZONE CASE NO. 1488A WHICH COV- ERED LOTS 7 THROUGH 12, BLOCK 12, SOUTHPORT ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS., BY REPEALING THE CONDI- TIONS MADE A PART THEREOF; IMPOSING IN LIEU THEREOF NEW CON- DITIONS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLI- CATION. WHEREAS, the City Council finds that after all notices have been given and hearings held as provided by law, that it is in the best interest of the citizens of the City of Lubbock to make the change in the zoning law as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the conditions made a part of Zoning Ordinance No. 5308 of the aty of Lubbock, BE and are hereby repealed, SECTION 2. THAT Zoning Ordinance No. 5308 of the City of Lub- bock, BE and is hereby amended by adding the conditions hereinafter set forth in lieu of tne conditions repealed in Section 1 hereinabove, which shall read as follows: "CONDITIONS" l. That lot coverage be limited to 50 percent. 2. That a 12. 5 foot building setback line be observed from the East-West alley, said line being measured from the center line of the alley. 3. That 6 foot permanent type screening fences be erected and permanently maintained as follows: a. Along the South property line I adjacent to tneEast-We st alley a solid masonry fence be erected with the building ~ : being considered as a part of said fence. No opening shall be permitted on the said alley in said building. No vehicular access shall be permitted through the fence along the East- West alley. b. Along the Avenue P property line to within 25 feet of the front property line, a solid fence of wood or masonry. c. From the 25 foot setback line on Avenue P t0.i the 41st Street property line, a fence be erected so as not to inter- fere with visual clearance. The permanent type screening material to be approved by the Traffic Engineer prior to erection. Said fences shall be erected prior to or concurrently with the first building permit. 4. That a 60 foot building setback line be observed from Avenue P. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. S~CTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
