AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF TH]
PRIMA FACIE SPEED LIMIT FOR ALL VEHICLES ON PORTIONS OF BROWN-
FIELD ROAD (U.S. 62}, WITHIN THE CORPORATE LIMITS OF THE CITY OF
LUBBOCK, LUBBOCK COUNTY, TEXAS: AUTHORIZING THE PLACING OF
SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICA-
TION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING
THAT ALL STREETS AND HIGHWAYS NOT SPECIFICALLY SET FORTH HERED
SHALL NOT BE EFFECTED BY THE PROVISIONS HEREOF AND THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED
LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CON -
FLICTS, AND PROVIDING A SAVINGS CLAUSE.
WHEREAS, the go¥-erning body of the City of Lubbock, as authorized by
Article 6701d, Section 169(b) Vernon1s Texas Civil Statutes. finds that certain
prima facie speed limits on certain highways are different from what is reasonab ~
or safe and should be altered and the preservation of public health and safety re-
quired alteration of said prima fa_sie speed limits as hereinafter set forth, NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the prima facie speed limit established by Article
6701d, Section 166(a)(l)--Vernon1s Texas Civil Statutes is altered and changed
for all vehicles on the following designated highways or streets in the corporate
limits of the City of Lubbock, Lubbock County, Texas, as shown below, to-wit:
NORTH SIDE
A 65 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at the West City Limits and extending
Northeast for 0. 980 miles. (To be established by the Texas
Highway Commission)
A 60 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at a point O. 980 miles Northeast of the
West City Limits and extending Northeast for O. 240 miles.
A 55 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at a point 1. 220 miles Northeast of the
West City Limits and extending Northeast for 1. 100 miles,
A 45 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at a point 2. 320 miles Northeast of the
West City Limits and extending Northeast for 0. 200 miles.
C
A 40 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at a point 2. 520 miles Northeast of the
West City Limits and extending Northeast for . 200 miles.
A 50 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at a point 2. 720 miles Northeast of the
West City Limits and extending Northeast for 1. 000 miles.
A 40 MPH Speed Zone on the North side of Brownfield Road
(U.S. 62) beginning at a point 3. 720 miles Northeast of the
West City Limits and extending Northeast for o. 420 miles.
SOUTH SIDE
A 65 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at the West City Limits and extending
Northeast for o. 980 miles. (To be established by the Texas
Highway Commission).
A 60 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at a point O. 980 miles Northeast of the
West City Limits and extending Northeast for 0, 390 miles.
A 55 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at a point 1. 370 miles Northeast of the
West City Limits and extending Northeast for 0. 950 miles.
A 45 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at a point 2. 320 miles Northeast of the
West City Limits and extending Northeast for 0. 200 miles.
A 40 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at a point 2. 520 miles Northeast of the
West City Limits and extending Northeast for O. 400 miles.
A 45 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at a point 2. 920 miles Northeast of the
West City Limits and extending Northeast for 0. 720 miles.
A 40 MPH Speed Zone on the South side of Brownfield Road
(U.S. 62) beginning at a point 3. 640 miles Northeast of the
West City Limits and extending Northeast for 0. 500 miles.
SECTION 2. THAT the City Manager is authorized and directed to cause
the placing of signs so as to clearly define the limits of the prima facie areas
set out in this Ordinance.
SECTION 3. THAT apy person, firm or corporation violating the prima
facie speed limit established by this Ordinance shall upon conviction be fined
any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS.
SECTION 4. THAT the City Secretary is authorized and directed to cau
the publication of the descriptive caption of this Ordinance together with the pen
alty as an alternative method of publication as provided by law.
SE CT ION 5. THAT all Ordinances or parts of Ordinances conflicting
with any of the provisions hereof are hereby repealed insofar as such conflict
exists,
SECTION 6. THAT all highways or streets not specivically set forth
in the preceding sections hereof shall not be affected by the provisions here-
of, and this Ordinance shall be cumulative of all other prima facie speed limit
Ordinances except those with which it specifically conflicts.
SECTION 7. THAT should any section, paragraph, sentence, clause,
phrase, or word of this Ordinance be declared unconstitutional or invalid for
any reason, the remainder of this Ordinance shall not be affected thereby,
AND IT IS SO ORDERED.
