Ed Bucy R-0-W .1!'1rst Re·ading April 14, 1994 Item /117 Se~ond Reading June 9, 1994 · Item /17 ORDINANCE NO. 9697 ----- AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A 15 FOOT ALLEY AND PORTION OF AS FOOT UTILITY EASEMENT, LOCATED ADJACENT TO LOT 3 GARRETT ADDITION, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF TillS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. I WHEREAS, the City Council finds that the portions of the alley and easement hereinafter described in the body of this Ordinance are no longer needed for alley ·and easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for alley and easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF TilE CITY OF LUBBOCK: SECTION 1. THAT those portions of the alley and easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for alley and easement purposes and for public use, and such alley and easement portions being more particularly described as follows: TRACT ONE :METES AND BOUNDS DESCRIPTION of a 20 foot by 30 foot tract of land in the Whiteley Subdivision to the City ofLubbock, Lubbock County, Texas being that tract described in Volume 443 Page 32 of the deed records of Lubbock County, Texas and further described as follows: BEGINNING at a W' iron rod with cap set at the Southwest comer of said 20 foot by 30 foot tract and the Southeast corner of Lot 3, Garrett Addition to the City of Lubbock, Lubbock County, Texas as recorded in Volume 1014 Page 77 of said deed records for the Southwest comer of this tract~ THENCE North, along the East line of said Lot 3, a distance of30.0 feet to a lh" iron rod with cap set at the Northwest corner of said 20 foot by 30 foot tract for the Northwest comer of this tract~ -1 - Jol4599Na 2 THENCE East a distance 20.0 feet to a W' iron rod with cap set at the Northeast comer of said 20 foot by 30 foot tract for the Northeast comer of this tract; THENCE South a distance of30.0 feet to a~~~ iron rod with cap set at the Southeast comer of said 20 foot by 30 foot tract for the Southeast comer of this tract; THENCE West a distance of20.0 feet to the Place ofBeginning. TRACT2 :METES AND BOUNDS DESCRIPTION of that portion of a 5 foot easement indicated on the plat of Lot 3 Garrett Addition to the City of Lubbock, Lubbock County, Texas recorded in Volume 1014 Page 77 of the Deed Records ofLubbock County, Texas to be closed and abandoned and being further described as follows: BEGINNING at a W' iron rod with cap set at the Southeast comer of said Lot 3 for the Southeast comer of this tract; THENCE West, along the South line of said Lot 3, a distance of 5. 00 feet to a comer of said easement for a comer of this tract; THENCE North, along the West line of said easement, a distance of 1 65.69 feet to a comer of said easement for a comer of this tract; THENCE N. 51°24'36" W, along the West line of said easement, a distance of59.81 feet to a comer of said easement for a comer ofthis tract; THENCE East a distance of8.02 feet to a point in the Northeast line of said Lot 3 for a comer of this tract; THENCE S. 51 °24'36" E, along the Northeast line of said Lot 3, a distance of55.95 feet toW' iron rod with cap set at the most easterly Northeast comer of said Lot 3 for a comer of this tract; THENCE South, along the east line of said Lot 3, a distance of 168.10 feet to the Place ofBeginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. -2- .. . . ,. :Vol 4599NCE 3. THAT should any sectio~ paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reaso~ the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
