ORDINANCE NO. 6025
AN ORDINANCE AMENDING ZONING ORDINANCE NO; 1695 AND
THE OF-FICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE
FOLLOWING CHANGE: ZONE CASE NO. 1 703: CHANGE A TRACT OF
LAND OUT OF SECTION 9, BLOCK E,' CITY OF LUBBOCK, LUBBOCK
COUNTY, TEXAS FROM A "C-211 TO A 11C•411 ZONING DISTRICT; SUBJECT
TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATION.'
WHEREAS., the proposed change in zoning districts as hereinafter
made has been duly presented to the Zoning and Planning Commission for its
recommendation, which was received by the City Council and, after due con.,,
sideration, the City Council finds that making the proposed change as here-
inafter set out will be in the public interest; and.,
WHEREAS, all conditions precedent required by law for a valid amenc -
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695., as
well as notices provided by Article lOllf, Vernon1s Annotated Civil Statutes,
amended in 1961, and notice was duly published in the Lubbock Morning Ava-
lanche Journal more that fifteen (15) days prior to the date of the public hear-
ing before the City Council on such proposed amendment, and the public hear
ing according to said notice was duly held in the City Council Room on the
second floor of the City Hall, Lubbock, Texas, at which time persons appear1ed
in support of the proposal; and, after said hearing, it was by the City Council
determined that it would be in the public interest, due to changed conditions.,
that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having
been introduced prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map
BE and· the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1 703
Change a tract of land out of Section 9, Block E,
City of Lubbock, Lubbock County, Texas, from
a 11c ... 2 11 to a "C-411 Zoning District. Property
is further described by metes and bounds to-wit:

BEGINNING at a point in the intersection of 50th Street
of the City of Lubbock and Utica Avenue;
THENCE South along the East boundary line of Utica Ave-
nue to the North boundary line of West-East alley;
THENCE East along said alley line 460 feet to a point;
THENCE North to the South boundary line of 50th Street;
THENCE West 460 feet along South boundary line of
50.th Street to the PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the use be limited to new and used car dealership.
2. That development shall be in accordance with the site plan presen-
ted and approved herewith, which is hereby adopted and made a part hereof
for all purposes. Said site plan, is identified as: Final Site Plan, Zone Case
1703, dated January 27, 1971, and initialed by Mayor Pro Tern, Deaton RiA',
3. That a solid six (6) foot permanent type screening fence of wood
or masonry shall be erected and permanently maintained along the South prop••
erty line and the East and West property lines to the front building line and
North along the front building line until joinder with the building, all in ac-
cordance with the site plan as above approved and identified.
4. That all signs shall conform to 11C-3>1 zone sign regulations.
5. That ingress and egress be established by the requirements of
Traffic Engineering.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the Zoning District indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or oper-
ating the subject property failing to comply with the conditions imposed by
Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof,
shall be subject to a fine not to exceed TWO IITJNDRED DOLLARS and each
and every day's violation thereof shall constitute a separate and distinct
offense.
The failure of any corporation owning or operating the subject propert
to comply with any of the conditions imposed by Section 1 hereof shall render
the President, Vice-President, General Manager, Local Manager and Local
Agent liable to the penalty prescribed in this section.
SECTION 4. THAT should any paragraph, sentence, clause, phrase,
or word of this Ordinance be declared unconstitutional or invalid for any rea-
son, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative meth d
provided by law.
