HomeMy WebLinkAboutOrdinance - 9871-1995 - Amending Chapter 29 Zoning Amending Section 29-17 C-2 Local Retail District - 12/07/1995First Reading December 7, 1995 :Item 1132 Second Reading December 14, 1995 Item 1110 ORDINANCE NO. 9871 AN ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES, CITY OF LUBBOC~ TEXAS ENTITLED "ZONING", BY AMENDING SECTION 29-17, ENTITLED "C-2 LOCAL RETAIL DISTRICT", TO ALLOW LAUNDRY AND DRY CLEANING SHOPS NOT EXCEEDING 5,000 SQUARE FEET AS A PERMITTED USE :AND BY AMENDING SECTION 29-18, ENTITLED "C-3 GENERAL RETAIL DISTRICT' !BY DELETING SECTION 29-18(c)(4), CLEANING, DYING OR DRY CLEANING SHOPS; iPROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY AND PROVIDING FOR .PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received jby the City Council and, after due consideration, the City Council fmds that due to changed • conditions, it would be expedient and in the interest of the public health, safety and general • welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the !Zoning Ordinance and Map have been fully complied with, as well as giving notices in i compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, as well as notices provided by Section 2ll.006(a), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing . according to said notice was duly held in the City Council Chamber of the Municipal Building, ·Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said · hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION l. THAT Section 29-l7(c)(5) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: "(5) Laundry and dry cleaning shops not exceeding five thousand (5,000) square feet. · SECTION 2. THAT Section 29-18(c)(4) of the Code of Ordinances of the City of Lubbock, Texas, is hereby deleted and reserved for future use. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 29-31 ofthe Zoning Ordinance of the City of Lubbock. · SECTION 4. THAT should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the description caption of this Ordinance as an alternative method of publication provided by law.
