AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES:
ZONE CASE NO. 2303-A; A ZONING CHANGE FROM A-1 TO C4 SPECIFIC USE
ZONING LIMITED TO MODEL HOME SALES AND OFFICE, ON A TRACT OUT OF
SECTION 9~ BLOCK J-S, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING
A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was received
by the City Council and, after due consideration, the City Council fmds that due to changed
conditions, it would be expedient and in the interest of the public health, safety and general
welfare to make those proposed changes in zoning; and
WHEREAS, the 1986 Comprehensive Land Use Plan is a guide to help the Lubbock
Planning and Zoning Commission and City Council determine the physical development of the
community; however, planning is a continuous process and change is inevitable; and
WHEREAS, the Lubbock Planning and Zoning Commission and City Council recognize
that the zone change on is a minor deviation from the 1986 Comprehensive Land Use Plan and
attempt to protect public and private commitments that have been previously based on the Plan;
and
WHEREAS, all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map have been fully complied with, including giving notices in
compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the I notices provided by the Texas Local Government Code §211.007 (V emon, 1990), and notice was
duly publish~d in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of
the public hearing before the City Council on the proposed amendment, and the public hearing
according to· said notice, was duly held in the City Council Chamber of the Municipal Building,
Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said
hearing, it was determined by the City Council that it would be in the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced
prior to first reading hereof; NOW THEREFORE:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2303-A
SECTION I. THAT Ordinance No. 7084 and the Official Zoning Map are amended as
follows:
A change of zoning under the provisions of Section 29-24(c)(24) of the Code of
Ordinances of the City of Lubbock from A-I to C-4 Specific Use limited to model
home sales and office on a tract out of Section 9, Block J-S, City of Lubbock,
Lubbock County, Texas, located West of West Loop 289 and South of 11th Place,
subject to conditions and being further described as follows:
METES AND BOUNDS DESCRIPTION on a 2.077 acre tract out of Section 9,
Block J~S, Lubbock, Lubbock County, Texas, being further described as follows:
BEGINNING at a 11211 rod set in the South line of 11th Place for the Northwest
comer of this tract, from whence a found 11211 rod at the Northeast comer of Lot
125, Revier Farm as recorded in Volume 1699, Page 250 which bears S.
89°58'18" W., a distance of288.00 feet;
THENCE N. 89°58'18" E., a distance of246.43 feet to a set 1/2" rod at a point of
curvature;
THENCE Southeasterly around a curve to the right, having a central angle of
38°29'05", a radius of 140.15 feet, tangents of 46.19 feet, and a chord of 87.74
feet on a bearing of S. 71°47'10" E., to a 112" rod set at a point of compound
curvature;
THENCE Southerly around a curve to the right, having a central angle of
89°32'06", a radius of 15.00 feet, tangents of 14.88 feet, a chord distance of21.13
feet on a bearing of S. 08°46'20" E., to a found 112" square pipe of a comer of this
tract;
THENCE Southwesterly around a curve to the left, having a central angle of
04°26'38", a radius of 5879.65 feet, tangents of228.13 feet, and a chord of 455.92
feet on a bearing of S. 33°48'22" W., to a found 1/211 square pipe for the Southeast
comer of this tract; ·
THENCE N. 62°33'37" W., a distance of 89.70 feet to a set 1/2" iron rod for the
Southwest comer of this tract;
THENCE N. 00°02'3011 E., a distance of 385.69 feet to the PLACE OF
BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That it be limited to model home sales and office and all unconditionally
permitted GO uses.
b. That gravel parking and walkways are indicated on site plan 2303~A.
SECTION 2. THAT the granting of this specific use zoning is hereby made subject to
compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly,
but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a
Building Permit shall be applied for and secured within thirty (30) months of the effective date of
the zone change or all undeveloped property shall automatically revert back to the previous
zoning classification, which in this case is the A-1 zone district; and if such reversion occurs, the
Director of Planning is directed to remove from the Zoning Map the legend indicating such
specific use. The Specific Use authorized by this Ordinance is permitted under provision of
Section 29-24(c)(24) of Codified Zoning Ordinance No. 7084 on the property described as a tract I
out of Section 9, Block J-S, City of Lubbock, Lubbock County, Texas. .

' SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a
misdemeanor punishable by a fme not to exceed Two Thousand and No/100 Dollars ($2,000.00)
as provided in Section 29·31 of the Zoning Ordinance of the City of Lubbock.
SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance
shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the
descriptive caption of this Ordinance as an alternative method provided by law.
