TEXAS, FROM A "C-4" TOAN "M-1" ZONING DISTRICT: PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recom-mendation, which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amend-ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more that fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor 9f the City Hall,. Lubbock., Texas, at which time persons appeared in support of the proposal; and, after said hearing., it was by the City Council determined that it would be in the public interest .. due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading here-of; NOW THEREFORE: . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 899A Change the following tract of land out of Section 6, Block B. Lubbock Countv. Texas. from a 11C-411

THENCE South along the West line of Hickory Avenue a distance of 1286.13 feet to an iron pipe set for the intersection of the North line of a 20 foot alley and the West line of Hickory Avenue~ the SE corner of this tract; THENCE West along tbJ North Side of the 20 foot alley~ 251. 5 feet to an i.ron pipe set in the East line of a .railroad right of way for a spur tract of the F. W. & D. C. R. R. Co., the SW corner of this tract; THENCE Northwesterly around a curve to the North in this right of way line, with a .radius of 564. 69 feet, a distance of 193. 34 feet to a point; THENCE North along the East line of the railroad right of way, 9 feet from and parallel to the center line of the track, 1095. 7 feet to a point at the intersection of the South line of U.S. Highway No. 84 on 34th Street with the East right of way line of said spur track 9 feet from the center line of the track, NW corner of this tract; THENCE North 89 ° 531 East, along the South line of U.S. Highway No. 84 on 34th Street, a distance of 285. 82 feet to the PLACE OF BEGlliNING. SECOND TRACT: BEGINNING at a point which is 2055 feet East and 626. 91 feet South of the Northwest corner of Section 6, Block B, Lubbock County~ Texas~ such point being in the East line of Globe Avenue; THENCE South along the East line of Globe Avenue, a distance of 685. 09 feet to a point for the Southwest corner of this tract, and being in the North line of a 20 foot alley; THENCE East along the North line of said 20 foot alley a distance of 239. 33 feet to a point in the West line of a F. W. & D. C. R. R. Company spur track;
'--" THENCE West 206. 18 feet to the PLACE OF BEGINNING. ~ SECTION 2. THAT from and after passage and effective date of this Ordinance~ said lots~ tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. Should any Section, paragraph, sentence~ clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
