ORDINANCE NO. 5897 --------
AN ORDINANCE ESTABLISHING A BUILDING LINE ON PORTIONS OF 3R
STREET FROM EAST OF AVENUE M TO UNIVERSITY AVENUE AS MORE PAR-
TICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; PROVIDING THA
NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER BE ERECTED, RE-
ERECTED OR SUBSTANTIALLY REPAIRED BETWEEN SUCH BUILDING LINE
AND THE RIGHT OF WAY LINES EXISTlliG PRIOR TO THE BUILDING LINE
ESTABLISHED HEREIN; REQUIRING EXISTING STRUCTURES ON, OR EXTEN-
DING BEYOND THE BUILDJNG LINE HERElli ESTABLISHED TO CON,FORM TO
SUCH BUILDJNG LINE WITHIN FIVE (5) YEARS; DEFIN"ING 11BUILDING LINE 11
AND PROVIDIN"G THAT SETBACK REQUIREMENTS UNDER THE CITY'S ZONING
ORDIN"ANCE AND AMENDMENTS THERETO BE DETERMINED FROM THE
BUILDING LINE HEREIN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTILIT
EXTENSIONS AND PUBLIC IMPROVEMENTS; REPEALING ALL ORDINANCES
ESTABLISHING BUILDING LINES WHICH CONFLICT HEREWITH; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION AND DECLARING AN EMER-
GENCY.
WHEREAS, Article-1105a, Revised Civil Statutes of Texas provides for
the establishment of building lines on any part of any street in a city; and,
WHEREAS, the City Council finds that public convenience, safety and
necessity in the City of Lubbock requires that a building line or right of way line
be established on 3rd Street as more particularly described in the body of this
Ordinance to prevent the construction and replacement of structures and trees
beyond the building line so established, such area being required in connection
with the widening, and improving that part of the streets described more particu-
larly hereinafter in the body of this Ordinance; and,
WHEREAS, the widening and improving of said 3rd Street and the estab-
lishment of a building line are necessary and will ultimately provide streets of
desirable and adequate width which will aid in relieving heavy traffic in congested
areas in accordance with the City's Urban Transportation Plan; and,
WHEREAS, the City Council finds that the establishment of such building
lines immediately, prior to rebuilding and repairing storm damaged buildings,
creates an emergency; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT a building line is hereby established on certain portion
of 3rd Street which are more particularly described as follows, to-wit:
A On the North side of 3rd Street beginning at a point on the
West property line of Lot 6, Block 24, of the F. R. Friends
Subdivision, said point being 30 feet North of the Southwest

corner of Lot 6, Block 24, of the F. R. Friends Subdivision
and extending East and parallel to the existing North property
line at 3rd Street to a point on the West property line of
University Avenue, said point being 30 feet North of the South-
east corner of Lot 10, Block 24, of the F. R. Friends Subdivision.
On the South side of 3rd Street beginning 30 feet South of the
Northwest corner of Lot 12, Block 1, of the Crouch Subdivision
at University Avenue and extending East and parallel to the
South property line of 3rd Street to a point 30 feet South of the
Northeast corner of Lot 12, Block 1, of the Blake Subdivision
at Avenue P.
On the North side of 3rd Street beginning at a point 35 feet North of
the Southwest corner of Lot 8, Block 9, of the Richmond Second '-Addition at Avenue P and extending East to a point 35 feet North
of the Southeast corner of the same lot.
On the North side of 3rd Street beginning at a point 37 feet
North of the Southwest corner of Lot 6, Block 8, of the Rich-
mond Second Addition at Avenue O and extending East to a
point 37 feet North of the Southeast corner of Lot 7. Block 8,
of the Richmond Second Addition.
On the North side of 3rd Street beginning at a point 37 feet North
of the Southeast corner of Block 8, Lot 7, of the Richmond
Second Addition and extending North 87° 19' East for a distance
of ±.648 feet to a point on the East property line of the P & SF
R.R., said point being on a line parallel to and 30 feet North
of the South property line of Block 7, William Tubbs Addition.
F On the South side of 3rd Street beginning at the Northeast
corner of Lot 8, Richmond Addition and extending North 87°
561 East for a distance of± 815 feet to the Northwest corner
of Block 1, Lot 11, William Tubbs Addition,
G On the North side of 3rd Street 30 feet North of and parallel
to the South property line beginning on the West property line
of Lot 1, Block 7, of the William Tubbs Addition and extending
East and parallel to the North property line of 3rd Street at
Avenue L, for a distance of± 390 feet, to a point 30 feet North
of the Southeast corner of Lot 1, Block 2, of the William Tubbs
Addition at Avenue K.
H On the South side of 3rd Street 50 feet South of the Northwest
corner of Lot 8, Block 12, of the William Tubbs Addition at
Avenue K and extending East to a point 50 feet South of the
Northeast corner of Lot 1, Block 8, of the Acuff Height Addition.

I On the South side of 3rd Street beginning at a point 50 feet
South of the Northeast corner of Lot 1, Block 8, of the Acuff
Height Addition and extending East and parallel to the existing
property line to a point on the East property line of Lot 1~
Block 2, of the Acuff Height Addition, said point being 40
feet South of the Northeast corner of Lot 1, Block 2, of the
Acuff Heights Addition.
J On the South side of 3rd Street beginning at the Southwest
corner of Lot 1, Block 7, of the Liff Sande.rs Addition and
running East and parallel to the existing North property line
of Lot 1, Block 7, of the Liff Sanders Addition to a point on
the West property line of Avenue F, said point being 50 feet
South of the Northeast corner of Lot 6, ~lock 4, of the Liff
Sanders Addition.
K On the South side of 3rd Street beginning at a point on the East
property line of Avenue F, said point being 30 feet South of the
Northwest corner of the Lubbock Housing Project and running
East and parallel to the existing South property line of 3rd
Street to a point on the West property line of Avenue D, said
point being 30 feet South of the Northeast corner of the Lubbock
Housing Project.
SECTION 2. THAT no building or structure shall hereafter be erected,
re-erected or substantially repaired and no new structure or parts thereof shall
be erected on that part of the street or land herein designated beyond said building
line hereinabove described.
SECTION 3. THAT all structures on or extending in whole or in part be-
yond the building line established by this Ordinance are hereby required to conforn
to the same as established in Section One (1) of this Ordinance within five (5) years
from the effective date hereof.
SECTION 4. The term 1'Building Line" as herein used shall be construed
to mean 11street right of way line 11, and the setback requirements under the City's
Zoning Ordinance and all amendments thereto shall apply in addition to the right
of way lines herein established, it being the intent and purpose of this Ordinance
to preserve all land beyond the building line herein established for ultimate street
purposes,
SECTION 5. If any section, paragraph, subdivision, clause, phrase or
provision of this Ordinance shall be judged invalid or held unconstitutional, the
same shall not affect the validity of the remainder of this Ordinance as a whole or
any part or provision thereof other than the part so decided to be invalid or un-
constitutional.

SECTION 6. THAT the City Secretary is hereby authorized to cause pub -
lication of the descriptive caption of this Ordinance as an alternative methoo pro-
vided by law.
SECTION 7. The fact that public necessity and convenience requires that
this Ordinance be passed as an emergency measure for reasons set forth in the
preamble hereof, the rule requiring that no Ordinance shall be finally passed on
the day of its introduction be suspended, and this Ordinance is declared to be an
emergency measure to take effect from and after its passage.
