ORDINANCE NO. 5895
AN ORDINANCE ESTABLISHING A BUILDING LINE ON PORTIONS OF 4T
STREET FROM EAST OF A VENUE M TO UNIVERSITY A VENUE AS MORE PAR-
TICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; PROVIDING THA
NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER BE ERECTED, RE-
ERECTED OR SUBSTANTIALLY REPAIRED BETWEEN SUCH BUILDING LINE
AND THE RIGHT OF WAY LINES EXISTING PRIOR TO THE BUILDJNG LINE
ESTABLISHED HEREIN; REQUIRING EXISTING STRUCTURES ON, OR EXTEN -
DING BEYOND THE BUILDING LINE HEREIN ESTABLISHED TO CONFORM TO
SUCH BUILDING LINE WITHIN FIVE (5) YEARS; DEFlNING 11BUILDING LINE"
AND PROVIDING THAT SETBACK REQUIREMENTS UNDER THE CITY'S ZONING
ORDINANCE AND AMENDMENTS THERETO BE DETERMINED FROM THE
BUILDlliG LINE HEREIN ESTABLISHED; PROVIDING EXCEP1.,IONS FOR UTILIT
EXTENSIONS AND PUBLIC IMPROVEMENTS; REPEALING ALL ORDINANCES
ESTABLISHING BUILDING L1NES WHICH CONFLICT HEREWITH; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION AND DECLARlliG AN EMER-
GENCY.
WHEREAS, Articl~ 1105a, Revised Civil Statutes of Texas provides for
the establishment of building lines on any part of any street in a city; and,
WHEREAS., the City Council finds that public convenience, safety and
necessity in the City of Lubbock requires that a building line or right of way line
be established on 4th Street as more particularly described in the body of this
Ordinance to prevent the construction and replacement of structures and trees
beyond the building line so established, such area being required in connection
with the widening, and improving that part of the streets described more particu-
larly hereinafter in the body of this Ordinance; and,
WHEREAS, the widening and improving of said 4th Street and the estab-
lishment of a building line are necessary and will ultimately provide streets of
desirable and adequate width which will aid in relieving heavy traffic in congested
areas in accordance with the City's Urban Transportation Plan; and,
WHEREAS, the City Council finds that the establishment of such building
lines immediately, prior to rebuilding and repairing storm damaged buildings,
creates an emergency; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT a building line is hereby established on certain portion
of 4th Street which are more particularly described as follows, to-wit:
A On the North side of 4th Street beginning at a point in the existing
North property line of 4th Street, said point being i:.28 feet West
of the Southeast corner of Lot 17. Block 2, of the Crouch
Subdivision and extending North 83° 31 1 East for a distance of
.± 123 feet to a point on the West property line of Lot 20, Block 2,
of the Crouch Subdivision, said point being 14 feet North of the
Southwest corner of Lot 20, Block 2, of the Crouch Subdivision.
B On the North side of 4th Street beginning at a point 14 feet
North of the Southwest corner of Lot 20, Block 2, of the Crouch
Subdivision and extending East and parallel to the existing North
property line of 4th Street to a point on the West property line of
Lot 1, Block 1, of the Garland Blake Subdivision, said point
being 14 feet North of the Southwest corner of Lot 1, Block 1,
of the Garland Blake Subdivision.
C On the North side of 4th Street beginnii;;ig at a point 14 feet
North of the Southwest corner of Lot 1, Block 1, of the Garland
Blake Subdivision and extending South 79 ° 111 East for a distance
of ±437 feet to a point, said point being on the East property lir;ie
of Avenre. 0 and being 7 feet North of the Southwest corner of
Lot 4, Richmond Addition.
D On the North side of 4th Street beginning at a point 7 feet North
of the Southwest corner of Lot 4, Richmond Addition and extending
East and parallel to the existing North property line of 4th Street
to a point on the East property line of Avenue M, said point being
7 feet North of the Southwest corner of Block 8, of the William
Tubbs Addition.
E On the North side of 4th Street beginning at a point 7 feet North
of the Southwest corner of Block 8~ of the William Tubbs Addition,
and extending South 86 ~ 551 East for a distance of± 130. 2 feet
to a point on the existing North property line of 4th Street, said
point being 130 feet East of the Southwest corner of Block 8, of
the William Tubbs Addition.
SECTION 2. THAT no building or structure shall hereafter be erected
re-erected or substantially repaired and no new structure or parts thereof shall
be erected on that part of the street or land herein designated beyond said building
line hereinabove described.
SECTION 3, THAT all structures on or extending in whole or in part be-
yond the building line established by this Ordinance are hereby required to confrorr
to. the same as established in Section One (1) of this Ordinance within five (5) years
from the effective date hereof.
SECTION 4. The term 11Building Line11 as herein used shall be construed
to mean 11street right of way line 11, and the setback requirements under the Oty's
- 2 -
Zoning Ordinance and all amendments thereto shall apply in addition to the right
of way lines herein established, it being the intent and purpose of this Ordinance
to preserve all land beyond the building line herein established for ultimate street
purposes.
SECTION 5. If any section, paragraph, subdivision, clause, phrase or
provision of this Ordinance shall be judged invalid or held unconstitutional, the
same shall not affect the validity of the remainder of this Ordinance as a whole or
any pa.rt or provision thereof other than the part so decided to be invalid or uncon-
stitutional.
SECTION 6. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method pro-
vided by law.

SECTION 7. The fact that public necessity and convenience requires that
this Ordinance be passed as an emergency measure for reasons set forth in the
preamble hereof, the rule requiring that no Ordinance shall be finally passed on
the day of its introduction be suspended, and this Ordinance is declared to be an
emergency measure to take effect from and after its passage.
