HOOOES ADDITION FROM A 11C-411 TO nA-211 ZONING DISTRIC n: SUBJECT TO CONDITION; ; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDlliG FOR PUBLICATION. 1 WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recom- mendation, which was received by the City Council and, after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011f, Vernon1s Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15} days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interei: , due to changed conditions, that the Zoning Ordinance and the Zoning Map be amend d in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAlliED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I l~-====l==---=============--===---=========-====-==-=-=====-===-=f===' SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map of the City of Lubbock BE and the same are hereby amended as follows, to-wit: A. The use district and zone classification of the following zoned property is hereby changed from 0 R-1" to "A-211 zoning district; All the 11R-111 zoned property between 51st Street and 58th Street, and between Avenue Hand Avenue Q South Drive, except that property owned by Lubbock Independent School District, the City of Lubbock and the property west of Avenue P. B. The use district and zone classification of the following lot is hereby changed from an 11R-111 to 11C-311 zoning district; I The South half of Blocks 2 and 3, C. N. Hodges Addition, except Lots 1 and 2, Block 3, C. N. Hodges Addition. C. The use district and zone classification of the following tract of land is hereby changed from a 11R-l11 to 11C-411 zoning district; D. A tract of land between Avenue Q South Drive and Avenue Hand between 58th Street and the alley North of the 11Traffi.c Circle 11. The use district and zone classification of the following lots is hereby changed from a 11R-211 to 11A-211 zoning district; Lots 4 and 11, Nancy Addition. E. The use district and zone classification of the following tract of land is hereby changed from a 11C-2A II to "C-3" zoning district; The North half of Blocks 2 and 3, C. N. Hodges Addition, except Lot 1, Block 3, C. N. Hodges Addition. F. The use district and zone classification of the following lot is hereby changed from a "C-311 to 11A-2!! zoning district; Lot 1, IDrive-In Addition. G. The use district and zone classification of the following lot is hereby changed from a 11C-311 to "C-411 zoning district; Lot 2~ Circle View Addition #2. H. The use district and zone classification of the following blocks of land is hereby changed from a 11C-411 to 11A-211 zoning district; Blocks 13 and 14, C. N. Hodges Addition. SUBJECT TO THE FOLLOWJNG CONDITION. 11A six (6) foot high permanent type solid screening fence of wooden or mas onry construction shall be erected and permanently maintained along the South side of Block 2, and along the South side of the East 350' of Block 3, C. N. Hodges Addition. Said fence in each block shall be erected prior to or concurrently with the first building permit in each block and shall have no vehicular type opening. Said fence shall be slanted o.r stepped dow beginning at a point 25 1 from the North-South Street property lines to a height of 2½ at the North-South Property Lines. 11 I SECTION 2. THAT from and after passage and effective date of thJs Ordinance, said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. Any person, firm or corporation owning or operating the subject property failing to comply with the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day's violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section 1 hereof shall render the President, Vice-President, General Manager, Local Manager and Local Agent liable to the penalty prescribed in this Section. SECTION 4. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method pro- vided by law.
