AN ORDINANCE DECLARING AND ESTABLISHING A CURFEW WITHIN
TITT': CITYc OF LUBBOCK; PROVIDING A PENALTY and DECLARING
AN :mERGENCY.
WHEREAS, the City Council of the City of Lubbock ~inds
that a state of emergency exists in the City of Lubbock due
to the injury, death and damage to property inflicted by
tornado, wind and storm on May 11, 1970 and the immediate
preservation of life, health, safety and protection of
property creates an emergency, NOW T~EFORE:
BE IT ORDAINED BY THE CITY CCTJNCIL OF THE CITY OF LUBBOCK: 1
Section 1. That during the state or emergency which now
exists in the City or Lubbock and until this ordinance is
repealed, a curfew is hereby imposed upon persons within
the City or Lubbock. The houvs during which this curfew
shall be imposed shall be established by the Mayor of the
City of Lubbock and in addition to establishing the hours
of curfew he is here by authorized to establish the areas
wherein such curfew shall be imposed.
Section 2. It shall be unlawf)rl for any person to walk, drive,
loiter, stroll upon, in or about the public streets, alleys,
parks, public buildings during the curfew hours and within
the curfew areas authorized herein and as set by the Mayor
of the City of Lubbocko
Provided however, this section shall not apply
to persons . authoFized by the proper officials of the City,
County, State and National authorities and further, shall
not apply to persons granted permission to enter the curfew
areas during the curfew hours for the purpose of at~ending
to persons or property within the areas.
Any person violating any portion of this or4inance
shall be guilty of a misdemeanor and upon conviction thereof
shall be subject toe rine in any sum not to exceed $200.00.
Section 3o The fact that the public health, safety and the
preservation of property requires that this Ordinance be passed
as an emergency measure for the reasons set forth in the
preamble hereof, the rule tha.t no Ordinance shall be finally
passed on the day of its introduction be suspended, and this--
Ordinance i~ declared to be an emergency measure to take effect
from and after its passage.
