JON 3 04 THEREOF BY ADDING A NEW SUB-SECTION (f) GOVERNING CLEAR- NCE BEFORE UTILITY SERVICE; AMENDING SECTION 306(c) THEREOF OVERNING CERTIFICATES OF OCCUPANCY; AMENDING SECTION 306(d) OVERNING TEMPORARY CERTIFICATES; PROVIDING A SAVINGS CLAUSE AN ROVIDING FOR PUBLICATION. WHEREAS, the City Council, after receiving the recommendations of the Buil g Board of Appeals, finds that the changes in the Building Code of the City of ubbock, as shown here:in below, would be in the best interest of the citizens of the ity of Lubbock; NOW THEREFORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT sub-section (d)4, of Section 304 of Ordinance No. 4725 of he City of Lubbock, BE and is hereby amended to read as follows: "4. FINAL INSPECTION: To be made after building is completed and ready for occupancy and all final utility inspections have been made and utilities approved. After such inspection, if satisfactory, a Certificate of Occupancy will be issued for occupancies where such is required by this Code." SECTION 2. THAT Section 304 of Ordinance No. 4725 of the City of Lubbock E and is hereby amended by adding thereto a ;new sub-section (f), which shall ead as follpws: "(f) CLEARANCE BEFORE UTILITY SERVICE: No permanent water, electrical or gas utility connection shall be made to any new building or structure and/ or to any building or structure having all addition or alteration made thereto, without first obtaining written approval from the Building Official that a f:inal Inspection has been made on such building or structure and approval has been granted. Temper ary utilities may be granted during construction. It shall be unlaw- ful for temporary utilities to be used for occupied buildings except as provided i~ Section 3 06 (d) of t.his"Chapter. The Building Inspector may, upon ten (10) days written notice, orde termination of utilities to wholly occupied or partially occupied buildings which have not complied with this Section 304. 0 ! ' I SECTION 3. THAT item 5 ·of sub.,.section (c) of Section 306 of Ordinance No. 4725 of the City of Lubbock BE and is hereby amended to read as follows: "5. A statement that the described portion of the building complies with the requirements of this Code for group of occupanc~v in which the proposed occupancy is classified, except for Code deviations and/or deficiencies, variances and/or exceptions which exist at the time the certificate is issued. 11 SECTION 4. THAT sub-section (d) of Section 306 of Ordinance No. 4725 oft City of Lubbock BE and is hereby amended by adding thereto a paragraph which shall read as follows: 11This temporary Certificate of Occupancy shall entitle the contractor of such building to secure utilities needed during such construction. Such temporary service shall be in the contractor's name and shall be his res ... ponsibility until notice of a change to an occupant1s name. n SECTION 5. Should any paragraph, sentence1 clause, phrase, or word of his Ordinance be declared unconstitutional or invalid for any reason, the remaind of this Ordinance shall not be affected thereby. SECTION 6. THAT the City Secretary is hereby authorized to cause publica- ion of the descriptive caption of this Ordinance as an alternative method provided y law.
