ON THIS, the~ day of March, 1970, the City Council of the
City of Lubbock, Texas, convened in regular session at the regular
meeting place thereof in the City Hall, the meeting being open to
the public and notice of said meeting, giving -the date, place and
subject thereof, having been posted as prescribed by Article
--------tt--6252:-17, Section 3A, V.A.T.C.s.:~-with the following members pre-
sent and in attendance, to wit:

ordinance:
ORDINANCE NO.
"AN ORDINANCE by the City Council of the City of Lubbock,
Texas, authorizing the issuance of $3,105,000 'CITY
OF LUBBOCK, TEXAS, GENERAL OBLIGATION BONDS, SERIES
1970,' dated April.15, _1970, for the purpose of making
permanent public improvements, to wit: $1,420,000 for
constructing improvements and extensions to the City's
Sanitary Sewer System; $105,000 for constructing
street improvements in and for said City, including
the acquisition of necessary right-of-way for express-
ways and other streets; $1,425,000 for constructing,
enlarging, extending and installing storm sewers,
drains, and gutter·s, and other improvements inci-
dental thereto, including acquisition of land for
drainage purposes and drainage area modifications

for mosquito control; and $155,000 for constructing,
improving and equipping fire station buildings and
the purchase of necessary sites therefor in and for
said City; prescribing the form of the bonds and the
form of the interest coupons, levying a continuing
direct annual ad valorem tax on all taxable property
within the limits of said City to pay the interest on
said bonds and to create a sinking fund for the redemp-
tion thereof and providing for the assessment and
collection of such .taxes; enacting provisions inci-
dent and relating to the subject and purpose of this
ordinance; and providing an effiective date."
?:~he ordinance was read in full, and thereupon, Councilman
li~lBY made a motion that the ordinance be passed
on first reading. Th~ motion was seconded by Councilman __ _ fe4.At« _ an~ carried by the following vote:

The Mayor then announced that .the ordinance was passed on

ORDINANCE NO.
AN ORDINANCE by the City Council of the City of
Lubbock, Texas, calling a bond election to be
held within said City for the authorization
of general obligation bonds, making provision
for the conduct of the election and other pro-
visions incident and related to the purpose
of this ordinance; and providing an effective
date.
WHEREAS, the City Council of the City of Lubbock, Texas,
deems it necessary, ·advisable and to the best interest of the
City and its inhabitants that the bonds of said City be issued
for the purpose hereinafter stated; and has determined to submit
the proposition for the authorization of such bonds to an elec-
tion as hereinafter set out; and,
WHEREAS, the City Council has found and hereby declares
there is an urgent public necessity for the acquisition and
construction of the improvements to be provided with the pro-
ceeds of said bonds at the earliest possible date for the
immediate preservation. of the public peace, property, health
and safety of the citizens of the City of Lubbock, and that by
virtue thereof, this ordinance shall be passed, adopted and made
effective at the earliest_ possible date; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1: That an election be held on the 21st day of
April, 1970, which date is not less than fifteen (15) nor more
than thirty (30) days from the date of the adoption hereof, at
which election the following proposition shall be submitted:
"SHALL the City Council of the City of Lubbock,·
~--~Texas, be authorized to i:ssue FOURTEEN MILLION DOLLARS
· ·($14,000,000) general obligation bonds of said City
for the purpose of making permanent public improvements,
t9 wit: planning, acquiring, establishing, developing,
and constructing an airport and air navigation facili-
ties and the site therefor, including buildings and
other facilities incidental to the operation thereof,
and the acquisition or elimination of airport hazards;
said bonds to mature serially over a period of years
not to exceed FORTY (40) years from their date, to be
issued and sold at any price or prices and to bear in-
terest at any rate·or rates as shall be determined
within the discretion of the City-Council at the time
of issuance; and to provide for the payment of ·principal
of and interest on said bonds by levying a tax suffi•
cient to pay the annual· interest and to create a sinking
fund sufficient to redeem said bonds as they become due?"

SECTION 2: That the official ballots for said election shall
be prepared in accordance with the V.A.T.S. Election Code so as to
-----tt-permit the electors to vote "FOR" or "AGAINST" the aforesaid propo-
sition which shall be set forth in substantially the following
form:
PRECINCT
"THE ISSUANCE OF $14,000,000 AIRPORT BONDS
AND THE LEVYING OF THE TAX IN PAYMENT THEREOF"
The word "FOR" and beneath it the word "AGAINST" shall be
made to appear on the left of the proposition. A square shall
be printed on the left of ~ach of the words "FOR" and "AGAINST",
and each elector.shall place an "X" in the square beside the
statement indicating the way he wishes to vote.
SECTION 3: That the polling places and officers of said
election shall be as ·follows, to wit:

Each Presiding Judge shall appoint not less than two (2) nor
more than eight (8) qualified clerks to serve and assist in holding
said election; provided that if the respective Presiding J~dge
here_;i.n appointed actually serve,s, the Alternate Presiding Judge
of-•ni~ polling place shall be o,ne of the clerks.
On election day the polls shall be open from 7:00 A. M. to
7:00 P. M.
Absentee voting shall be conducted at the City Secretary's
Office in the City Hall, in accordance with the provisions of
V.A.T.S. Election Code, Chapter 5.
SECTION 4: All resident qualified electors of the City,
including those who own ~axable property in said City and who
have duly rendered the same for taxation, shall be permitted to
vote at said election. That at said .election two separate ballot
boxes shall be provided at the polling place. In one box only
resident qualified elector~ who own taxable property and who have
duly rendered the same for taxation shall be allowed to vote. In
another box all resident qualified electors (who are otherwise
qualified but do not own taxable property which has been duly
rendered for taxation) shall be allowed to vote. The votes cast
in each of said boxes shall be recorded, returned and canvassed in such manner as will reflect separately the votes cast by the·
qualified electors who own taxable property and who hav-e duly ren-
dered the same for taxation from the votes cast by all qualified
electors (including those who own taxable property and who have
duly rendered the same for taxation).
SECTION 5: That a substantial copy of this ordinance shall
serve as proper notice of said election. Said notice shall be
posted in the election precinct or precincts and at the City
Hall not less than fourteen (14) full days prior to the date on
which said election is to be held, and be published on the same
day in each of two successive weeks in a newspaper of general
circulation in said City, published therein, the first of said
publications to be made not less than fourteen (14) full days
· prior to the date set for said election.
SECTION 6: That this ordinance shall become effective upon
its final adoption.
